An Act to consolidate the enactments amending section eighty-four of the Public Works Act 1900, so far as it relates to the making and maintaining of fencing along certain lines of railway, and the enactments permitting the construction of certain lines of railway on, along, or by the side of public roads.
1 Name of Act
This Act may be cited as the Government Railways (Fencing) Act 1902.
2 Repeal
The Acts mentioned in the First Schedule are to the extent therein expressed hereby repealed.
3 Definition
In this Act Constructing Authority means the Constructing Authority as defined by the Public Works Act 1900 and includes the Railway Commissioners appointed or continued in office by or under the Government Railways Act 1901.
4 Fencing not required on certain lines
Notwithstanding the provisions of section eighty-four of the Public Works Act 1900, the Constructing Authority shall not in respect of any of the lines of railway mentioned in the Second Schedule be required or compelled, nor shall it be the duty of the said Authority, to make or maintain any fence along the said lines of railway for the accommodation of any person or for any purpose whatsoever; but the said Authority may, in its discretion, make and maintain such fences in connection with the said lines of railway as it may think fit.
5 Certain lines may be constructed along a road
The lines of railway mentioned in the Third Schedule may be constructed on, or along, or by the side of any public road or highway.
