An Act to vest certain lands at East Maitland in His Majesty; to repeal the East Maitland Public Reserve Act; to amend the Local Government Validation and Enabling Act 1914, and certain other Acts in certain respects; and for purposes connected therewith.
1 Name of Act and commencement
(1) This Act may be cited as the East Maitland Pasturage Reserve (Divesting) Act 1937.(2) This Act shall commence upon a day to be appointed by the Governor and notified by proclamation published in the Gazette.
2 Repeals
The enactments mentioned in the First Schedule to this Act are to the extent therein expressed hereby repealed.
3 Vesting
(1) The land described in the Second Schedule to this Act is hereby vested in His Majesty.(2) The said land shall be deemed to be land temporarily reserved from sale or lease under the Crown Lands Consolidation Act 1913, as amended by subsequent Acts, and may, on revocation of the reserve in accordance with the provisions of that Act, be disposed of or otherwise dealt with under the provisions of that Act.(3) Any estate, interest, power or right which, immediately before the commencement of this Act, was vested in or held by the Council of the Municipality of East Maitland or any other person, is hereby divested, and the said Council and all such persons are hereby discharged from any duties, liabilities or obligations existing immediately before the commencement of this Act in respect of or in relation to the said land.(4) Any trusts, conditions, encumbrances or dedications affecting the said land immediately before the commencement of this Act are hereby revoked and annulled.(5) The said land shall be deemed to be exempt from occupation for mining or mining purposes, or for residence under any miner’s right, or for business purposes under any business licence in all respects as if at the commencement of this Act the Governor had by notification pursuant to subsection three of section fourteen of the Mining Act 1906, as amended by subsequent Acts, exempted the said land from such occupation, and the provisions of that subsection, in relation to the revocation and amendment of a notification under that subsection, shall apply accordingly.
4 Saving
Nothing in this Act shall affect any estate, right, title, or interest under the Mining Act 1906, as amended by subsequent Acts, acquired prior to the commencement of this Act in respect of the said land.

ALL that piece or parcel of land situated in the parish of Maitland, county of Northumberland, and containing 604 acres more or less: Commencing at the north-western corner of portion 64, parish of Alnwick, and bounded thence on the north by the southern boundary of portion 3, parish of Maitland, bearing westerly to the western side of Sinclair-street, town of East Maitland; on the west by that side of that street bearing southerly to a point distant 150 links west from the north-western corner of portion 227; thence on the south by a line and the northern boundary of that portion easterly to its most north-eastern corner; again on the west by the eastern boundary of that portion and its prolongation southerly to its intersection with the north-easterly prolongation of the south-eastern boundary of the same portion; thence on the north-west by that prolongation and boundary south-westerly to a point on the north-eastern side of the public road from Raymond Terrace to East Maitland (being the most southern corner of portion 227); thence on the north-east by that side of that road north-westerly to the western side of Sinclair-street aforesaid; thence again on the west by that side of that street southerly to a point distant 150 links west of the north-western corner of portion 7; thence again on the south by a line and the northern boundary of that portion easterly to the western boundary of portion 46, parish of Alnwick; thence on the east by part of that boundary of that portion, and the western boundary of portion 64, parish of Alnwick aforesaid, northerly to the point of commencement; but exclusive of an area commencing on the north-eastern side of the road from East Maitland to Raymond Terrace at a point bearing south-easterly 50 links from the most southern corner of portion 227 aforesaid, and bounded thence on the north-west, north and south-east by lines bearing 68 degrees 30 minutes 5 chains 60 links, 78 degrees 11 chains, 106 degrees one chain eighty links, and 195 degrees 30 minutes 11 chains 50 links to the north-eastern side of the road from East Maitland to Raymond Terrace aforesaid; thence on the north-east by that side of that road south-easterly to its intersection with the north-easterly prolongation of the south-eastern boundary of portion 202; thence on the south-east by a line and the south-eastern boundary of that portion, south-westerly to its southernmost corner; thence on the south-west by the south-western boundary of that portion, a line north-westerly one chain to the most southern corner of portion 201 and by lines bearing 301 degrees 4 chains 90 links, 296 degrees 5 chains 35 links, 291 degrees 2 chains 25 links; thence again on the north-west by a line bearing 21 degrees to the north-eastern side of the road from Raymond Terrace to East Maitland aforesaid; and thence by that side of that road north-westerly to the point of commencement; also exclusive of portion 206; reserve for volunteer rifle range notified 26 June 1877 and a rectangular area 100 feet wide along the south-eastern boundary of that reserve; and also exclusive of roads, streets and railway lands.
