Division 1 General powers
320   Application of this Part
Subject to the provisions of this Act:
(a)  this Part shall apply to municipalities and shires, and
(b)  the powers and duties conferred and imposed upon a council under this Part shall apply in respect of each area to the council of the area.
321   Acquisition of lands for pre-planning, replanning and reconstruction
(1)  The council may acquire, in any mode authorised under Part 25, any land for the purpose of:
(a)  undertaking:
(i)  the planning of new roads and subdivisions,
(ii)  the rearrangement of existing roads and the replanning or resubdivision of existing parcels of land,
(iii)  the demolition, rearrangement and reconstruction of buildings and works, and
(iv)  the improvement and embellishment of the area,
(b)  doing all or any of the following things:
(i)  demolishing or repairing any building or erection thereon,
(ii)  constructing new buildings or erections thereon,
(iii)  altering, widening or extending any existing public road adjacent thereto,
(iv)  closing any existing public road through such land,
(v)  constructing and opening any new public road thereon,
(vi)  altering the levels of such land, and altering existing drains, and constructing new drains and stormwater channels thereon,
(vii)  generally altering, remodelling, and improving such land and buildings in such manner as the council may think fit,
(viii)  selling or leasing the whole or any portion of such land, in one or more lots, as elsewhere in this Act provided.
(2)  In respect of land so acquired the council may:
(a)  undertake all or any of the works referred to in paragraph (a) of subsection (1),
(b)  do all or any of the things specified in paragraph (b) of subsection (1).
(3)  The acquisition of land for any purpose specified in subsection (1) shall be deemed to be acquisition of land for a purpose of this Act within the meaning of section 532.

Division 2 New roads and subdivisions
323   New roads and subdivisions
(1)  A public road shall not be opened and land shall not be subdivided except in accordance with the provisions of this Act.
(2)  It is hereby declared that for the purposes of this Act a reference to opening a public road includes widening a public road.
(3)  Where:
(a)  any instrument registered in the office of the Registrar-General before the commencement of the Local Government and Conveyancing (Amendment) Act 1964 purports to dedicate any land for use as a public road,
(b)  such instrument was accepted in writing by or on behalf of the council of the area in which the land was situated, and
(c)  the provisions of section 327 were not complied with in relation to the opening of such road,
such dedication shall neither be, nor be deemed ever to have been, invalid by reason only of the failure to comply with the provisions of the said section 327.

324   Provisions respecting blind roads
(1)  A road other than a pathway shall not be opened as a blind road:
(a)  unless there is also provided at least one pathway to give access from the blind end into a main, secondary, or local road, or
(b)  unless such road gives access at its blind end to a railway station, wharf, public reserve, river bank, lake, sea beach, or the shore of any tidal water, or
(c)  except where, in view of exceptional circumstances, the council approves.
(2)  A pathway shall not be opened as a blind road unless one end communicates with a main, or secondary, or local road, and, except where the council considers that there are exceptional circumstances justifying the opening of the pathway, the blind end gives access to a railway station, public wharf, public reserve, river bank, lake, sea beach, or the shore of any tidal water.
(3)  For the purposes of this section any road which does not give access at both ends to either a main, secondary, or local road shall be deemed to be a blind road.

325   Treatment of corners
At any junction or intersection made by opening any road, the person opening the road shall make provision for the planning of the corners formed at such junction or intersection to the satisfaction of the council in such manner as will facilitate the flow of traffic.
326   Residential districts—density of houses and allotments
(1)  The council may, with respect to any residential district, fix the number of houses per hectare which shall be the standard number permitted in any future subdivision of land within the district.
(2)  In ascertaining the area for the purpose of applying such standard the whole area of the land proposed to be sub-divided, including any proposed roads, public reserves, open spaces, and the like, shall be embraced.
(3)  In any subdivision made after a standard number of houses per hectare has been fixed there shall not be a greater number of separate parcels per hectare than the standard number so fixed.
(4)  Notwithstanding anything to the contrary contained in this section the council may:
(a)  fix building units not exceeding 2 hectares in extent, within which the number of houses and separate parcels of land per hectare may be varied above and below the standard number, provided that the total number of the houses and separate parcels of land for any unit shall not exceed the total found by multiplying the number of hectares in the unit by the standard number,
(b)  vary the standard number in the case of any subdivision in which by agreement with the council special provision is made for roads, public reserves, open spaces, and the like.

327   Conditions to be observed before opening new roads or subdivision
(1)  Subject to the provisions of this Act a public road shall not be opened, and in a case where a subdivision provides for the opening of a public road land shall not be subdivided until:
(a)  an application in respect thereof accompanied by plans and specifications thereof has been approved under this Act, and
(b)  the roads have been constructed and drained to the satisfaction of the council in accordance with the approved application, plans, and specifications, and with any conditions attached to any such approval, and
(bi)  where the Land and Environment Court has made a requirement referred to in section 40 of the Land and Environment Court Act 1979—that requirement has been complied with, and
(c)  the applicant has placed in the road permanent survey marks in the position and manner and of the character prescribed, and
(d)  the town or shire clerk has certified that:
(i)  the requirements of this Act (other than the requirement for the registration of plans) have been complied with, and
(ii)  in the case of a subdivision (being a subdivision that provides for the opening of a public road) of land that is wholly or partly within:
(A)  the area of operations referred to in Part 4 of the Water Board (Corporatisation) Act 1994, or
(A1)  the area of operations within the meaning of Part 5 of the Hunter Water Board (Corporatisation) Act 1991, or
(B)  a Water Supply Authority’s area of operations, within the meaning of the Water Supply Authorities Act 1987,
a certificate of compliance has been issued under section 73 of the Water Board (Corporatisation) Act 1994, section 50 of the Hunter Water Board (Corporatisation) Act 1991 or section 27 of the Water Supply Authorities Act 1987, as the case requires, in respect of the subdivision, and
(d1)  subject to subsection (4), the town or shire clerk has certified to the applicant, where the land or any part of the land is declared land as defined in subsection (1) of section 3 of the Land Development Contribution Management Act 1970, that the applicant has produced to him a certificate of the State Planning Authority of New South Wales certifying:
(i)  that any contribution payable under that Act (excluding any such contribution that is required to be deducted under section 14 of that Act but including any such contribution payable as a consequence of the granting of the council’s approval to the opening of the public road or the subdivision of the land) has been paid, or
(ii)  that satisfactory arrangements for the payment of any such contribution have been made, and
(e)  a plan of the road or of any subdivision containing the road (such plan bearing the signatures of all necessary parties, a statement containing such particulars as may be necessary to identify the title to the land comprised in such plan, and the aforesaid certificates) has been registered in the office of the Registrar-General.
Paragraph (c) shall not apply, and shall be deemed never to have applied, where the road to be opened, or the road provided for in the subdivision, is a lane or pathway nor to a widening of a public road.
(2)  In a case where a subdivision does not provide for the opening of a public road, land shall not be subdivided until:
(a)  an application in respect thereof, accompanied by plans, has been approved under this Act, and
(ai)  where the Land and Environment Court has made a requirement referred to in section 40 of the Land and Environment Court Act 1979—that requirement has been complied with, and
(b)  the town or shire clerk has certified that:
(i)  the requirements of this Act (other than the requirement for the registration of plans) have been complied with, and
(ii)  in the case of a subdivision of land that is wholly or partly within:
(A)  the area of operations referred to in Part 4 of the Water Board (Corporatisation) Act 1994, or
(A1)  the Hunter Water Board’s area of operations, within the meaning of the Hunter Water Board Act 1988, or
(B)  a Water Supply Authority’s area of operations, within the meaning of the Water Supply Authorities Act 1987,
a certificate of compliance has been issued under section 73 of the Water Board (Corporatisation) Act 1994, section 27 of the Hunter Water Board Act 1988 or section 27 of the Water Supply Authorities Act 1987, as the case requires, in respect of the subdivision, and
(b1)  subject to subsection (4), the town or shire clerk has certified to the applicant, where the land or any part of the land is declared land as defined in subsection (1) of section 3 of the Land Development Contribution Management Act 1970, that the applicant has produced to him a certificate of the State Planning Authority of New South Wales certifying:
(i)  that any contribution payable under that Act (excluding any such contribution that is required to be deducted under section 14 of that Act but including any such contribution payable as a consequence of the granting of the council’s approval to the subdivision of the land) has been paid, or
(ii)  that satisfactory arrangements for the payment of any such contribution have been made, and
(c)  a plan of the subdivision (such plan bearing a statement containing such particulars as may be necessary to identify the title to the land comprised in such plan, and the aforesaid certificates) has been registered in the office of the Registrar-General.
(3)  Nothing in this section shall be deemed to render any agreement to sell, let, or otherwise dispose of any land illegal or void by reason merely that it is entered into before an application in respect of the subdivision has been approved by the council, but the agreement shall be deemed to be made subject to such approval being obtained.
(4)  Paragraph (d1) of subsection (1) and paragraph (b1) of subsection (2) do not apply in relation to land that is prescribed land within the meaning of section 56A of the Land Development Contribution Management Act 1970.

327AA   Restriction on disposal of land in current plan
(1)  In this section:
current plan, in relation to any land, means:
(a)  a plan of subdivision registered or recorded in the office of the Registrar-General (whether before or after the commencement of the Local Government (Amendment) Act 1970) but does not include so much of that plan as relates to land included in a plan of subdivision (other than a plan of subdivision for lease purposes in accordance with section 289K) registered or recorded in that office after the plan of subdivision firstmentioned in this paragraph was so registered or recorded, or
(b)  a Crown plan (whether made before or after the commencement of the Local Government (Amendment) Act 1970) showing lots or portions, but does not include:
(i)  a Crown plan which shows land specified in the plan as being proposed to be resumed, appropriated or purchased by a body authorised by any Act to resume or appropriate land unless it is a plan referred to in paragraph (g) of the definition of plan of subdivision in this subsection,
(ii)  a Crown plan which shows land specified in the plan as being leased or proposed to be leased for a period that, including any period of renewal, does not or will not exceed five years,
(iii)  so much of a Crown plan as relates to land included in a plan of subdivision registered or recorded in the office of the Registrar-General after the Crown plan was prepared, or
(iv)  so much of a Crown plan as relates to land included in a subsequent Crown plan showing lots or portions.
plan of subdivision means:
(a)  a plan registered in the office of the Registrar-General under paragraph (e) of subsection (1), or paragraph (c) of subsection (2), of section 327,
(b)  a plan registered or recorded in the office of the Registrar-General showing land that is a lot or portion in a lawful division of land, whenever made, not being land that is a lot in a plan of subdivision (as defined in paragraph (a), (c), (d), (e), (f) or (g) of this definition) so registered or recorded,
(c)  a strata plan, a strata plan of subdivision or a strata plan of consolidation registered under the Strata Schemes (Freehold Development) Act 1973 or the Strata Schemes (Leasehold Development) Act 1986,
(c1)  a plan of the residue of a parcel after a road widening, being a plan required by the Registrar-General under section 53 of the Strata Titles Act 1973 to accompany a copy of an order for termination of a strata scheme,
(d)  a map or plan of land comprised in an application made under Part 4 of the Real Property Act 1900,
(e)  where a folio of the Register has been created for any land following the correction of any error or misdescription of the boundaries of the land, any plan showing that land with boundaries as so corrected,
(f)  a plan registered in the office of the Registrar-General in accordance with subsection (5) of section 314B, and
(g)  a plan registered or recorded in the office of the Registrar-General showing land that has been resumed, appropriated or purchased by a body authorised by any Act to resume or appropriate land.
Register means the Register kept under the Real Property Act 1900.
(2)  Notwithstanding the provisions of section 195I of the Conveyancing Act 1919, where any land is included in a current plan, that land shall not be disposed of by way of sale, conveyance, transfer, partition or lease (other than a lease for a period that, including any period for which the lease could be renewed by the exercise of an option, does not exceed 5 years) or be mortgaged unless the land is a lot or portion shown in the current plan and the Registrar-General may refuse to register any instrument evidencing any disposition or mortgage that contravenes the provisions of this subsection.
(3)  The Registrar-General may indicate upon any plan which is in his custody or otherwise record the registration or recording of any later plan comprising some or all of the land in such firstmentioned plan.
(4)  Subsection (2) does not apply to:
(a)  land that is disposed of or mortgaged as the whole of the residue:
(i)  of a lot or portion in a current plan after part of that lot, or portion has been resumed, appropriated or purchased by a body authorised by any Act to resume or appropriate land,
(ii)  of a lot or portion in a current plan after part of that lot or portion has been opened as a public road, or
(iii)  of the land comprised in a folio of the register after part of the land has been shown in a current plan,
(b)  land that is disposed of or mortgaged as the whole of the land comprised in a folio of the Register,
(c)  the disposition or mortgaging of land that is part of a lot or portion in a current plan different parts of which are owned in severalty where:
(i)  one of the several owners disposes of or mortgages the part of the lot or portion owned by him to an owner of any other part, or
(ii)  the several owners dispose of or mortgage the lot or portion to some other person,
(d)  the disposition or mortgaging of land that is a lot or portion in a lawful division of land, whenever made, not being a lot or portion shown in a plan of subdivision registered or recorded in the office of the Registrar-General that is not a current plan or shown in a Crown plan that is not a current plan,
(e)  the disposition of land that is part of a lot or portion in a current plan where the part of the lot or portion is vested in a person in the capacity of executor, administrator or trustee and:
(i)  no other part of the lot or portion is vested in him in that capacity and the disposition is or gives effect to a sale by him in the execution of his powers as executor, administrator or trustee or is made for the purpose of giving effect to the terms of a will or codicil or a deed of settlement or for the purpose of distributing the estate of a deceased intestate, or
(ii)  the disposition gives effect to the terms of a will, codicil or deed of settlement executed before the registration of the current plan,
(f)  the disposition of land that is part of a lot or portion in a current plan by a mortgagee exercising a power of sale under a mortgage which was executed before the date of assent to the Local Government (Amendment) Act 1976, where no other part of that lot or portion is subject to the mortgage, or
(g)  the disposition of land that is part of a lot or portion in a current plan where the disposition:
(i)  is necessary to give effect to an order, direction or judgment of a court of competent jurisdiction,
(ii)  is or gives effect to a sale of land pursuant to a writ of execution,
(iii)  is or gives effect to a sale of land pursuant to section 602,
(iv)  is or gives effect to a sale of land pursuant to section 61 of the Mental Health Act 1958, or
(v)  is or gives effect to a sale of land pursuant to any power conferred by or under the Bankruptcy Act 1966 of the Parliament of the Commonwealth,
and the person making the disposition does not have power to dispose of any other part of the lot or portion.

327A   Temporary roads in subdivisions
(1)  In this section, the expressions isolated road and temporary road have the meanings respectively ascribed thereto in section 276B.
(2)  Notwithstanding any other provision of this Act, where a subdivision of land involves the opening of a road (in this subsection referred to as a planned road) and that road, when provided in conformity with the requirements of an environmental planning instrument or of a council imposed under the Environmental Planning and Assessment Act 1979:
(a)  will be an isolated road, the plan of that subdivision shall not be approved by the council, or
(b)  will give direct access only to an isolated road, approval of that plan of subdivision may be refused by the council,
unless the plan also provides for the opening of a public road as a temporary road, to give access to the planned road.
(3)  A temporary road shall comprise one or more lots in the subdivision of the land in which the temporary road is to be provided.
(4)  Nothing in this section prevents the creation on the registration of a plan of subdivision in accordance with section 88B of the Conveyancing Act 1919, of an easement or restriction as to user in respect of a lot or lots comprised in a temporary road.
(5)  Any covenant that immediately before the opening of a public road as a temporary road applied to any lot comprised in the temporary road and any restriction as to user referred to in subsection (4) in respect of any such lot shall until the temporary road is closed be suspended in its operation in respect of that lot.
(6)  The provisions of:
(a)  Divisions 3, 9, 10, 11 and 15 of Part 9,
(b)  where the lot or lots comprised in the temporary road is or are not under the provisions of the Real Property Act 1900, subsection (1) of section 232, in so far as they entitle the council to be registered as the proprietor of a road under the provisions of that Act,
(c)  paragraph (c) of subsection (3) of section 232,
(d)  subsections (4) and (5) of section 233 and section 243,
(e)  section 519B, and
(f)  any Act, ordinance or regulation relating to the placing of permanent marks,
shall not apply to a public road that is a temporary road.

327B   Certificate of title for temporary road
Upon the registration of a plan of subdivision which provides for the opening of a temporary road referred to in section 327A over land under the provisions of the Real Property Act 1900, or upon bringing under the provisions of that Act land over which such a temporary road has been opened, the Registrar-General shall, notwithstanding anything contained in any Act:
(a)  create a folio of the Register kept under the Real Property Act 1900, for the estate or interest of the council in each lot comprised in the temporary road,
(b)  record therein a caveat forbidding the registration of any dealings not consistent with the provisions of this Act relating to temporary roads, and
(c)  issue to the council a certificate of title for each such lot.

328   Certain alternative conditions
Any applicant, instead of executing the work of constructing and draining the roads, as hereinbefore provided, may, if the council so agrees, either:
(a)  pay to the council such sum as may be agreed upon with the council as the cost of executing such work, and agree with the council as to when such work shall be executed by the council, or
(b)  give to the council security to the satisfaction of the council that he will execute such work within such time as may be fixed by the council.

329   Opening new road or subdivision by instalments
Where approval has been given as aforesaid, the town or shire clerk may give his certificate that the requirements of this Act have been complied with in respect of any separate part of any proposed road or subdivision, if the work of construction and draining to be executed upon such part has been done to the satisfaction of the council, and if the applicant has, with regard to the remainder of such work, either made payment as aforesaid or given security as aforesaid.
330   Exceptional case of subdivision
Where, after the erection of a building on land the property of one owner, it is found that such building encroaches upon land the property of another owner to the extent of not more than 900 millimetres, and where the encroaching owner desires to purchase the land upon which the encroachment stands, the council shall, upon the application of the owner of the land which is encroached upon, and upon satisfying itself that there has not been collusion, but that everything has been done in good faith without intention to evade the law, approve of the necessary subdivision.

331   Decisions on applications, and notices to applicants
(1)  Applications under this Division shall be submitted to the council by the owner of the land or by some person authorised by him in writing.
(2)  The council may approve of any such application, or approve subject to conditions, or disapprove.
(2A)  The power of a council to approve of an application subject to conditions includes the power to approve of an application subject to the condition that the applicant shall provide to the council security for the payment of the cost of making good any damage or injury, referred to in section 245A (1) (b), caused as a consequence of construction work, being the work to which the approval relates.
(2B)  A security referred to in subsection (2A) shall be:
(a)  the deposit with the council of such reasonable amount, or
(b)  a guarantee satisfactory to the council for such reasonable amount,
as is determined by the council and specified in the condition.
(3)  The council shall cause notice to be given to the applicant of its decision.
(4)  In the case of an approval given subject to conditions or of a disapproval, the reasons therefor shall be indicated in the notice which shall also indicate that the applicant has a right of appeal under this Act against the decision of the council.
(5)  In any decision under this Division with respect to a proposed road the council shall classify such road if it be not already classified by the council.
(6)  An application under this Division, so far as it relates to development that may only be carried out with consent under the Environmental Planning and Assessment Act 1979, shall not be approved or approved subject to conditions unless that consent has been granted either unconditionally or subject to conditions, but nothing in this subsection prevents the council from granting that approval at the same time as that consent is granted.
(7)  Notwithstanding subsection (2), the council shall disapprove an application where the subdivision referred to therein would, if carried out, result in a contravention of an environmental planning instrument or the Environmental Planning and Assessment Act 1979, whether arising in relation to that subdivision or any other development.

331A   Subdivision of land within the area of operations of a water authority
(1)  If:
(a)  the council approves, or approves subject to conditions, of an application under this Division (other than an application relating only to the opening of a public road) in respect of land that is wholly or partly within:
(i)  the area of operations referred to in Part 4 of the Water Board (Corporatisation) Act 1994, or
(ia)  the area of operations within the meaning of the Hunter Water Board (Corporatisation) Act 1991, or
(ii)  a Water Supply Authority’s area of operations, within the meaning of the Water Supply Authorities Act 1987, or
(b)  on an appeal against the decision or all of the decisions of the council in respect of an application under this Division (other than an application relating only to the opening of a public road) in respect of any such land, the Land and Environment Court makes a decision other than a decision dismissing the appeal,
the council shall, as soon as practicable after the approval is given or the decision is made, forward to Sydney Water Corporation Limited, the Hunter Water Corporation Limited or the Water Supply Authority, as the case may be, a copy of the plan of subdivision together with a copy of any conditions subject to which the council has approved of the application, or a copy of any such decision of the Court relating to the application, as the case requires.
(2)  The council shall cause to be endorsed on every notice of its decision, in relation to land referred to in subsection (1) (a), given under section 331 (3) (other than a notice that the application has been disapproved) a statement that the land may not be subdivided until a compliance certificate has been issued under section 73 of the Water Board (Corporatisation) Act 1994, section 50 of the Hunter Water Board (Corporatisation) Act 1991 or section 27 of the Water Supply Authorities Act 1987, as the case requires, in respect of this subdivision.
(3)  The town or shire clerk shall not give a certificate under section 327 (1) (d) or (2) (b) in relation to the subdivision of land that is wholly or partly within:
(a)  the area of operations referred to in Part 4 of the Water Board (Corporatisation) Act 1994, or
(ai)  the area of operations within the meaning of the Hunter Water Board (Corporatisation) Act 1991, or
(b)  a Water Supply Authority’s area of operations, within the meaning of the Water Supply Authorities Act 1987,
unless there has been lodged with the town or shire clerk a certificate of compliance issued under section 73 of the Water Board (Corporatisation) Act 1994, section 50 of the Hunter Water Board (Corporatisation) Act 1991 or section 27 of the Water Supply Authorities Act 1987, as the case requires, in respect of this subdivision.
(4)    (Repealed)

332   Subjects for consideration respecting new roads
(1)  Where consent under the Environmental Planning and Assessment Act 1979, is required in respect of the opening of a road, then, in respect of any application for approval of the opening of a road, the council shall take into consideration:
(a)  the method of draining the road necessary in the circumstances, present and prospective, and the disposal of the drainage,
(b)  the drainage reserves or drainage easements to be provided,
(c)  the character of construction of the road necessary in the circumstances, present and prospective, and the necessity for the erection of road signs as part of the work of that construction,
(d)  whether or not kerbing, guttering and footpaths should be provided,
(e)  the treatment of junctions or intersections of roads,
(f)  the classification of the road,
(g)  whether the district is a residential district, and
(h)  if any proposed new road will be a lane, whether or not a lane should be permitted in the circumstances.
(2)  Where consent under the Environmental Planning and Assessment Act 1979, is not required in respect of the opening of a road, then, in respect of any application for approval of such a road, the council shall take into consideration:
(a)  the matters enumerated in subsection (1),
(b)  the situation and planning of the road in relation to public convenience, present and prospective, to intercommunication with neighbouring localities within or without the area,
(c)  the necessity for the planting of trees with tree-guards in the road, and
(d)  the provisions of any environmental planning instrument.

333   Subjects for consideration respecting subdivisions
(1)  Where consent under the Environmental Planning and Assessment Act 1979 is required in respect of a subdivision, then, in respect of any application for approval of a subdivision of land (whether the subdivision involves the opening of a road or not), the council shall take into consideration:
(a)  the size and shape of each separate parcel,
(b)  the length of road frontage of each separate parcel,
(c)  the situation and planning of the separate parcels in relation to public convenience, present and prospective,
(d)  the existing and proposed means of access to each separate parcel,
(e)  whether the district is or probably will be a residential district,
(f)  the drainage of the land, the drains proposed to be constructed and the drainage reserves and drainage easements to be provided,
(g)  whether the land has been declared unsuitable for building upon under the provisions of the Public Health Act 1902,
(h)  whether the land is subject to flooding or tidal inundation, and
(i)  whether the land is or probably will be subject to subsidence or slip.
(1A)  Where consent under the Environmental Planning and Assessment Act 1979 is not required in respect of the subdivision, then, in respect of any application for approval of the subdivision, the council shall take into consideration:
(a)  the matters enumerated in subsection (1),
(b)  the standard number of houses to the hectare fixed by the council,
(c)  the amount of land to be provided as a public reserve out of the land to be subdivided,
(d)  the provisions of any environmental planning instrument, including the use to which the land is proposed to be, or may be, put following the subdivision, in accordance with or consistently with that instrument, and
(e)  whether any trees on the land should be preserved.
(1B)  If a proposed subdivision is to form part of a scheme under the Community Land Development Act 1989, the council must, in addition to the matters referred to in subsections (1) and (1A), take into consideration:
(a)  the character and construction of roads, open access ways and private access ways within the scheme, and
(b)  the width of the roads, open access ways and private access ways, and
(c)  any other matters relating to the roads and access ways that the Minister directs, by order published in the Gazette, are to be taken into consideration under this section.
(1C)  If a plan of subdivision:
(a)  is a community plan, precinct plan or neighbourhood plan under the Community Land Development Act 1989, and
(b)  includes a public reserve,
the plan may not be approved under this Act unless there is an adjoining public road or other public place giving the public direct access to the reserve.
(2)  Where the council is entitled to impose as a condition of its approval of a subdivision of land a requirement that the applicant for such approval shall provide a portion of the land proposed to be subdivided as a public reserve, the council may, instead of imposing that condition, impose as a condition of its approval a requirement that such applicant shall pay to the council a sum of money which shall be reasonable in the particular circumstances of the case. Any sum of money so paid shall, subject to any direction of the Minister under subsection (3), be placed by the council in the trust fund and shall not be applied otherwise than in the acquisition by the council of land for the purposes of public recreation or in the improvement and embellishment of any public reserve under its care, control, and management.
(3)  The Minister may, generally or in any particular case or class of cases, direct a council as to:
(a)  in the case of a condition referred to in subsection (2) requiring the payment of a sum of money:
(i)  the means by which or the factors in relation to which the sum may or may not be calculated or determined, and
(ii)  the maximum amount of any such sum, and
(b)  the particular purposes with respect to public recreation or the improvement and embellishment of public reserves to which money paid as referred to in subsection (2) may or may not be applied.
(4)  A council to which a direction is given under subsection (3) shall comply, and is hereby empowered to comply, with the direction in accordance with the terms of the direction.
(5)  Notwithstanding the other provisions of this section, a council shall not, in granting approval to the subdivision of land in relation to which a direction under subsection (3) applies, impose a condition which is not in accordance with the terms of the direction.

334   Preservation of roads by laying pipes before construction of roads
(1)  The council may, when giving its approval for the opening of any new road, specify in the approval and cause to be indicated on the plan the position in which water and gas mains shall be placed when laid in the road, and the position where the gutters or road drains are to be constructed. The council shall before fixing the position of mains as aforesaid seek the advice of the persons or bodies engaged in the supply of water and gas.
(2)  When water or gas mains are thereafter laid in such road by any person, whether under the authority of any statute or otherwise, they shall unless the council otherwise permit be laid in the position so indicated.
(3)  Where any person opens a new road or subdivides any land fronting any existing public road which is not yet constructed in some permanent manner, the council may require such person to make such provision (by laying conduits across the road at suitable intervals) as will enable gas and water service pipes to be laid to connect the mains with the various parcels of land fronting the road and owned by that person without digging up the constructed carriageway of the road. Any such conduits shall be laid in such manner as the council may require, provided that before specifying its requirements under this subsection the council shall seek the advice of the persons or bodies engaged in supplying gas and water in the area as to the most suitable form of conduit, the method of laying it, and incidental matters.
(4)  The laying of pipes hereunder shall be deemed to be a portion of the work of the construction and drainage of a new road under this Part, and the other provisions of this Part shall apply thereto accordingly.
(5)    (Repealed)
(6)  Nothing in this section shall apply:
(a)  in a municipality unless there is a water or gas supply for the municipality at the time of the proposed subdivision, or
(b)  in a shire, unless at the time of the proposed subdivision the land is within the area served by the water or gas supply of any village, town or urban area or within the area to be served by any such supply under construction or about to be constructed at the time of the subdivision.

335   Lapsing of approval
(1)  Any approval given under this Part shall lapse at the end of two years from the date thereof, or such longer period as may be fixed in the approval, if the requirements of this Part have not been complied with in respect of:
(a)  the construction and draining of roads, and
(b)  the giving of security, and
(c)  the making of payments to the council in respect of the making, draining, and marking of roads.
(2)  The council may if good cause be shown grant an extension or renewal of such approval beyond such period.
(3)  Subsections (1) and (2) shall apply to any extension or renewal under this section as if such extension or renewal were an original approval.
(4)  Such approval may also be cancelled by the council upon application by the holder of the approval at any time before the plan of the road or subdivision is registered in the office of the Registrar-General.
(5)  On such lapse or cancellation the council shall refund any unexpended balance of moneys paid to the council in respect of the execution of works in connection with such approval.
336   Registration of plan
(1)  On registration in the office of the Registrar-General of a plan referred to in subsection (1) of section 327, which bears a statement of intention to dedicate specified land as a public road, such land shall be deemed to be opened as a public road and thereby to be dedicated accordingly and shall without any further assurance vest in the council for an estate in fee-simple by virtue of such registration and of this Act.
(2)  The provisions of section 232 shall mutatis mutandis apply to any road vested in the council by this section.
(3)  The provisions of this section as in force immediately before the commencement of the Local Government and Conveyancing (Amendment) Act 1964 shall continue to apply to and in respect of the plan of any road, and the plan of any subdivision which provides for the opening of a road, approved by the council before such commencement notwithstanding the repeal of such provisions by that Act.

337   Savings as to roads
(1)  Nothing in this Division shall preclude the opening of any road in accordance with any approval which was before the commencement of this Act given under the Local Government Act 1906.
(2)  Nothing in this Division shall preclude the subdivision of any land in accordance with any approval which was before the commencement of this Act given under the Local Government Act 1906.
(3)  A subdivision which has not been approved by the council under this Act or under the Local Government Act 1906 shall not hereafter be made except in accordance with the provisions of this Division.
(4)  A separate parcel of land shall not be subdivided into further separate parcels or allotments except under the provisions of this Division.
338   Numbering of plans under Real Property Act 1900
(1)  In the case of a road on land under the Real Property Act 1900 opened after the commencement of this Act, the Registrar-General shall not number any plan under that Act, which is not substantially in accordance with an approved plan, accompanied by the prescribed certificate, under this Part, and he may refuse to register a transfer of any land which in his opinion has frontage to any such road.
(2)  In the case of the subdividing after the commencement of this Act of land under the Real Property Act 1900, the Registrar-General shall not number any plan under that Act which is not substantially in accordance with an approved plan accompanied by the prescribed certificate under this Part, and he may refuse to register a transfer of any land which in his opinion forms part of a subdivision not complying with the requirements of this Act.
339   Penalty
(1)  Any person who opens any road or subdivides any land otherwise than in accordance with the provisions of this Act, or who disposes of any land in contravention of subsection (2) of section 327AA, shall be guilty of an offence under this Act.
(2)  A contravention of this or any other section of this Part shall not invalidate or be deemed to have invalidated any instrument intended to affect or evidence the title to any land.

340   Execution of work
If any person fails to execute any work which he should execute under this Part the council may execute the work and may recover the cost thereof from such person irrespective of any penalty which may be imposed by or under this Act.
340A   Public garden and recreation spaces
(1)  Where in the subdivision of land provision is made for public garden and recreation space, such space shall be conveyed or transferred to the council if the council at any time so requires, or where such space is adjacent to land reserved or dedicated, under the Crown Lands Act 1989 for the purpose of public recreation, or to a public park which is not vested in the council, such space shall, if the council at any time so directs, be surrendered to the Crown, and upon such surrender the land comprised in such space shall be deemed to be Crown lands within the meaning of the Crown Lands Act 1989 and may be dealt with accordingly.
(2)  This section shall apply where such provision was made in a subdivision effected prior to the commencement of the Local Government (Amendment) Act 1927, as well as to cases in which it is made after such commencement.
(3)  This section shall not apply to a subdivision of land the plan of which was approved by the council after the commencement of the Local Government and Conveyancing (Amendment) Act 1964.

340B   Drainage reserves
(1)  Where in the subdivision of land provision is made for a drainage reserve, such reserve shall be conveyed or transferred to the council if the council at any time so requires.
(2)  This section shall extend to subdivisions made since the passing of the Local Government (Validation and Amendment) Act 1922, as well as to subdivisions made after the passing of the Local Government (Amendment) Act 1927.
(3)  This section shall not apply to a subdivision of land the plan of which was approved by the council after the commencement of the Local Government and Conveyancing (Amendment) Act 1964.

340C   Vesting of certain lands in councils by notice
(1)  Where the council is entitled under section 340A or 340B to require the conveyance or transfer to it of land in a plan of subdivision and such land was marked in such plan with the words “public garden and recreation space”, or, as the case may be, the words “drainage reserve” or “reserve for drainage”, the council, instead of requiring such conveyance or transfer, may by a notice published in the Gazette notify that such land is vested in the council and thereupon such land shall without further assurance and by virtue of that notice and of this Act vest in the council for an estate in fee-simple and:
(a)  in the case of any such land so marked with the words “public garden and recreation space” shall be deemed to be dedicated as a public reserve, and
(b)  in the case of any such land so marked with the words “drainage reserve” or “reserve for drainage” shall, subject to this Act, be held by the council for drainage purposes.
(2)  When creating a folio of the Register kept under the Real Property Act 1900 for the estate or interest of the council in any land so marked with the words “public garden and recreation space” and vested in the council under this section the Registrar-General shall, by reference to this section or otherwise, indicate that such land is dedicated as a public reserve.

340D   Public reserves
(1)  On registration in the office of the Registrar-General of a plan:
(a)  referred to in section 327,
(b)  approved by the council after the commencement of the Local Government and Conveyancing (Amendment) Act 1964, and
(c)  on which any land is marked with the words “public reserve”,
such land shall be dedicated as a public reserve and shall without any further assurance vest in the council for an estate in fee-simple by virtue of such registration and of this Act.
(2)  Where the land so dedicated is under the provisions of the Real Property Act 1900, the Registrar-General shall, on registration of such plan, create a folio of the Register kept under that Act for the estate or interest of the council in the land so dedicated and shall, by a reference to this section or otherwise, indicate therein that such land is held as a public reserve.

340E   Drainage reserves

340F   Sale or lease of land held for drainage purposes
If in the opinion of the council any land vested in or acquired by it as a drainage reserve or for drainage purposes is no longer required for drainage purposes, the council may, subject to this Act, sell or lease such land subject to such restrictions or reservations as it thinks fit or may dedicate or use the land for any purpose for which the council is authorised under this Act to dedicate or use land.

341   Appeals
Any applicant for approval to open a public road or to subdivide land, who is aggrieved by any decision of a council on his application made under this Part, or under any ordinance made thereunder or by any neglect or delay of the council to give within a period of forty days after service on the council of the application a decision with respect thereto, may appeal to the Land and Environment Court:
(a)  within twelve months after the date on which he received notice of the council’s decision or after the expiration of that period of forty days, as the case may be or within such longer period as the court may in special circumstances allow.
