Constitution (Executive Council Processes) Regulation 2020



1   Name of Regulation
This Regulation is the Constitution (Executive Council Processes) Regulation 2020.

2   Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.
3   Definition
(1)  In this Regulation—
the Act means the Constitution Act 1902.
Note—
The Act and the Interpretation Act 1987 contain definitions and other provisions that affect the interpretation and application of this Regulation.
(2)  Notes included in this Regulation do not form part of this Regulation.
3A   Meaning of “prescribed period”—the Act, Sch 8, cl 1(b)(ii)
For the Act, Schedule 8, clause 1, definition of prescribed period, paragraph (b)(ii), 26 September 2023 is prescribed.

4   Special provision for Executive Council meetings during COVID-19 pandemic
(1)  During the prescribed period, a meeting of the Executive Council is to be held in person or by means of a teleconference or video conference.
(2)  During the prescribed period, the Governor, and the Vice-President or senior member if presiding in the absence of the Governor or Vice-President, respectively, is to preside at a meeting of the Executive Council in person or by means of a teleconference or video conference.
