Public Authorities Superannuation (Cootamundra Shire Council Gas Employees) (Savings and Transitional) Regulation 1988



1   Name of Regulation
This Regulation may be cited as the Public Authorities Superannuation (Cootamundra Shire Council Gas Employees) (Savings and Transitional) Regulation 1988.

2   Definitions
In this Regulation:
Council means the Council of the Shire of Cootamundra.
gas includes gas that is not reticulated gas.
preserved benefit means a preserved benefit provided by section 32 (5) of the Act.
3   Schedule 9 to apply to transfer of certain Council gas employees
(1)  The transfer of a contributor or former contributor to whom this subclause relates is a transfer of employment to which Schedule 9 to the Act applies.
(2)  Subclause (1) relates to a contributor or former contributor who:
(a)  was transferred from the employment of the Council to the City of Goulburn Gas and Coke Company Limited in consequence of clause 13.6 of an agreement executed by the Council and that Company on 19 October 1987, and
(b)  immediately before that transfer took effect, was employed solely or predominantly in the production, sale or distribution of gas or in management activities connected with that production, sale or distribution.
4   Disposition of preserved benefit
(1)  Subject to subclause (2), if a preserved benefit is payable under clause 3 of Schedule 9 to the Act in respect of a person who is, by virtue of clause 3 of this Regulation, a transferred contributor or transferred former contributor to whom that Schedule applies, the Board shall pay the benefit to the trustees of The Australian Gas Light Company’s Employees Superannuation Fund.
(2)  The Board may pay a preserved benefit under subclause (1) only if it is satisfied that The Australian Gas Light Company will exercise its powers under the trust deed establishing the Fund referred to in that subclause in a way that will ensure that the benefit payable to or in respect of the person to whom the benefit relates will take account of that person’s period of service with the Council and the amount of benefit to which that person is entitled.
