1 What is this plan called?
This plan is called Kosciuszko Regional Environmental Plan 1998—(Snowy River).
2 Where does this plan apply?
(1) This plan applies to the whole of the Snowy River local government area, being the region declared by order published in Gazette No 140 on 7 October 1983 at page 4625, except land within the Kosciuszko National Park.(2) In this plan, the land to which this plan applies is referred to as the region.(3) To avoid any doubt, this plan does not apply to the following land:Land to which State Environmental Planning Policy (Kosciuszko National Park—Alpine Resorts) 2007 appliescl 2: Am 6.9.2002; 2007 (643), Sch 1.5.
3 How does this plan affect other plans?
This plan repeals the Kosciusko Regional Environmental Plan—Snowy River gazetted on 14 November 1986.
4 What is the aim of this plan?
This plan aims to provide a framework for environmental planning, development and resource management decisions for the region.
5 What are the regional objectives?
The objectives of this plan for land within the region are to encourage:(a) ecologically sustainable development by promoting activities which will result in the protection and maintenance of the ecological resources of the region,(b) sustainable economic development that generates a range of employment opportunities and social benefits for the region,(c) the maintenance and protection of the natural, cultural, heritage and scenic values of the region,(d) the management of the region’s water resources in a manner which will ensure these resources are sustainable, and(e) the protection of threatened species, populations and ecological communities.
6 How are the aim and objectives to be achieved?
(1) The Council, when preparing a draft local environmental plan or a development control plan, and a consent authority, when determining a development application relating to land within the region, must consider the aim and objectives of this plan and the Kosciuszko (Snowy River) Region Planning and Development Guidelines.(2) A public authority proposing to carry out development which does not require development consent, but which has the potential to adversely affect the environment of the region to a significant extent, must consider the aim and objectives of this plan and the Kosciuszko (Snowy River) Region Planning and Development Guidelines.(3) In this clause:Kosciuszko (Snowy River) Region Planning and Development Guidelines means the regional planning and development guidelines of the Department of Urban Affairs and Planning for the Kosciuszko (Snowy River) Region (kept in the Queanbeyan Office of that Department and copies of which are kept in the offices of the Council).the Council means the Snowy River Shire Council.
