Part 1 Preliminary
1   Name of plan
This plan may be cited as Hunter’s Hill Local Environmental Plan No 1.
2   Aims, objectives etc
The aim and objective of this plan is to conserve the identity of the Municipality of Hunter’s Hill, as established by its heritage, character, topography and residential amenity, by:
(a)  conserving the environmental heritage significance, the foreshore and riverscape, the townscape quality and tree covered environment of the Municipality through regulation of the use and development of land, buildings and structures,
(b)  retaining specific evidence of the thematic development of the environmental heritage of the Municipality through conservation of items of environmental heritage,
(b1)  integrating heritage conservation into the planning and development control processes,
(b2)  providing for public involvement in the matters relating to the conservation of the area’s environmental heritage,
(b3)  ensuring that new development is undertaken in a manner that is sympathetic to, and does not detract from, the heritage significance of the items and their settings, as well as streetscapes and landscapes and the distinctive character that they impart to the land to which this plan applies,
(c)  increasing the area and standard of public open space in the Municipality,
(d)  improving public access to the shores of the Lane Cove and Parramatta Rivers,
(e)  providing off-street parking facilities at or near shopping centres at Boronia Park, Gladesville and Hunters Hill, and
(f)  providing, or assisting in the provision of, public amenities and support services consistent with the development of the area.

3   Land to which plan applies
(1)  Except as provided by subclause (2), this plan applies to land within the Municipality of Hunter’s Hill, as shown on the map, with boundaries as indicated on the map.
(2)  This plan does not apply to lot 3 in Deposited Plan 549711, known as Kelly’s Bush, being land excluded from the operation of this plan pursuant to section 70 (4) of the Act.
4   Relationship to other environmental planning instruments
(1)  This plan:
(a)  amends the County of Cumberland Planning Scheme Ordinance in the manner set forth in clause 26, and
(b)  except as provided by paragraph (a), repeals any deemed environmental planning instrument and any local environmental plan which, immediately before the appointed day, applied to or in respect of the land to which this plan applies, but only in so far as it purports to apply to or in respect of that land.
(2)  State Environmental Planning Policy No 5—Housing for Aged or Disabled Persons applies to land within a conservation area as if that land were not specified in Schedule 2 to that Policy.

6   Interpretation
(1)  In this plan, except in so far as the context or subject-matter otherwise indicates or requires:
advertisement means the use of any space for the display of symbols, messages or other devices for promotional purposes or for conveying information, instructions, directions or the like, whether or not the display includes the erection of a structure or the carrying out of work.
alter:
(a)  in relation to an item of the environmental heritage, means:
(i)  make structural changes to the item, or
(ii)  make non-structural changes to the detail, fabric, finish or appearance of the outside of the item (including the painting or plastering of unpainted or unplastered surfaces), other than changes that maintain the existing detail, fabric, finish or appearance of the outside of the item, and
(b)  in relation to a building or work within a conservation area, that is not an item of the environmental heritage, means:
(i)  make structural changes to the outside of the building or work, or
(ii)  make non-structural changes to the detail, fabric, finish or appearance of the outside of the building or work, (including the painting or plastering of unpainted or unplastered surfaces), other than changes that maintain the existing detail, fabric, finish or appearance of the outside of the building or work.
appointed day means the day upon which this plan takes effect.
bed and breakfast establishment means a dwelling-house used by the permanent residents to provide temporary tourist accommodation and which may include meals but which does not:
(a)  accommodate more than four visitors at any one time and does not utilise more than two bedrooms for guest accommodation, or
(b)  contain facilities in guest rooms for the preparation of meals, or
(c)  involve the employment of persons other than those residents.
community centre means a building or place owned or controlled by the council and providing amenities for the purposes of:
(a)  a public library, rest rooms, meeting rooms or any similar place,
(b)  the provision of health services or any similar services, or
(c)  indoor recreation, child minding or any similar activity.
community facilities means facilities for activities which promote the physical, cultural or intellectual welfare of persons within the community, being facilities provided by:
(a)  the council, or
(b)  a body of persons associated for the purposes of the physical, cultural or intellectual welfare of persons within the community.
conservation area means the land shown edged heavy black and marked “conservation area” on the Conservation and Heritage Map.
contributory building means a building situated outside the conservation area which contributes to the history, identity and character of the area and which is listed in Schedule 7.
council means the Council of the Municipality of Hunter’s Hill.
county road means:
(a)  any existing road indicated on the map by a continuous red band on white between firm black lines,
(b)  any proposed road indicated on the map by a broken red band between broken black lines, and
(c)  any proposed road widening indicated on the map by a broken red band between a firm black line and a broken black line.
demolition, in relation to an item of the environmental heritage or to a building, work, relic or place within a conservation area, means the damaging, defacing, destruction, pulling down or removal of the item, building, work, relic or place in whole or in part.
dwelling means a room or suite of rooms occupied or used or so constructed, designed or adapted as to be capable of being occupied or used as a separate domicile.
dwelling-house means a building containing one but not more than one dwelling.
heritage significance means historic, scientific, cultural, social, archaeological, architectural, natural or aesthetic significance.
integrated housing means the alteration of or addition to an existing dwelling-house to create two, but not more than two, separate dwellings, or the erection of a second detached dwelling on an allotment of land in addition to an existing dwelling house, or the erection of two detached dwellings on an allotment, or the erection of a building containing two dwellings.
item of the environmental heritage means a building, work, relic, tree or place described in Schedule 6.
low-rise multi-unit housing means 3 or more dwellings (attached or, if detached, in a group), commonly known as villa homes, townhouses, row houses or terrace houses, each of which has a separate individual entrance and direct private access to its own private open space at ground level.
maintenance means the continuous protective care of the fabric of an item of the environmental heritage and its setting.
recreation area means:
(a)  a children’s playground,
(b)  an area used for sporting activities or sporting facilities, or
(c)  an area used to provide facilities for recreational activities which promote the physical, cultural or intellectual welfare of persons within the community, being facilities provided by:
(i)  the council, or
(ii)  a body of persons associated for the purposes of the physical, cultural or intellectual welfare of persons within the community.
relic means any deposit, object or material evidence relating to the use or settlement of the Municipality of Hunter’s Hill which is 50 or more years old.
residential flat building means a building containing three or more dwellings.
shop with housing means a building containing a shop or other commercial premises (or both) at street level, and also containing one or more dwellings.
storey means the space within a building which is situated between one floor level and the floor level next above or, if there is no floor above, the ceiling or roof above, but does not include:
(a)  any such space which is designed, constructed or adapted solely for the accommodation of:
(i)  lift shafts and meter rooms, or
(ii)  storerooms having a ceiling height not exceeding 1400mm, or
(iii)  foundation areas not exceeding a height of 1400mm above ground level, or
(b)  a car parking area not projecting more than 1400mm above ground level at any point.
the Conservation and Heritage Map means the map marked “Hunter’s Hill Local Environmental Plan No 14—Heritage Conservation” as amended by the overlay or additional maps (or, if sheets of maps are specified, by the specified overlay sheets or additional sheets of the maps) marked as follows:

(a)  to a building or place used for a purpose, includes a reference to a building or place intended to be used for the purpose,

7   Model provisions
Subject to clause 6 (2) (d), the Environmental Planning and Assessment Model Provisions 1980, except the definition of advertisement, advertising structure, dwellings, dwelling-houses, map and residential flat building in clause 4 (1) and clauses 7, 15 and 18 thereof, are adopted for the purposes of this plan.

8   Consent authority
The council shall be the consent authority for the purposes of this plan.
Part 2 General restrictions on development of land
9   Carrying out of development
Except as otherwise provided by this plan, in relation to land within a zone specified in the Table to this clause, the purposes, if any, for which:
(a)  development that does not require consent maybe carried out,
(b)  development that requires consent maybe carried out, and
(c)  development is prohibited,
are specified under the headings “Development that does not require consent”, “Development which requires consent” and “Prohibited”, respectively, appearing in the matter relating to the zone.

9A   Exempt development
(1)  Development of minimal environmental impact specified as exempt development in Development Control Plan No 19—Exempt and Complying Development as adopted by the council on 28 February 2000 is exempt development, despite any other provision of this plan, provided it satisfies all of the applicable criteria in Table 1 of the Development Control Plan and it:
(a)  does not cause interference with the amenity of the neighbourhood by reason of the emission of noise, vibration, smell, fumes, smoke, vapour, steam, soot, ash, dust, waste water, waste products, grit or oil or otherwise, and
(b)  meets the deemed-to-satisfy provisions of the Building Code of Australia, and
(c)  does not obstruct drainage of the site on which it is carried out or cause diversion of stormwater onto an adjoining property, and
(d)  does not restrict any vehicular or required pedestrian paths of travel, and
(e)  is carried out at least one metre from any easement or public sewer main and complies with the building over sewer requirements of Sydney Water Corporation applying to the land, and
(f)  does not involve the removal, lopping, topping or ringbarking of a tree, and
(g)  is not on land that contains threatened species, populations or endangered ecological communities or land that is affected by a recovery plan or threat abatement plan under the Threatened Species Conservation Act 1995, and
(h)  is not on land identified in an environmental planning instrument as containing acid sulphate soils and requiring the adequacy of an acid sulphate management plan to be considered before consent can be granted to the development, and
(i)  is not on land that is:
(i)  dedicated or reserved under the National Parks and Wildlife Act 1974, or
(ii)  dedicated or reserved under the Crown Lands Act 1989 for the preservation of flora, fauna or geological formations or for other environmental protection purposes, or
(iii)  listed on the State Heritage Register or subject to an Order under the Heritage Act, or
(iv)  an Aboriginal place under the National Parks and Wildlife Act 1974, or
(v)  identified in an environmental planning instrument as a wetland, or is within 20 metres of a wetland, or
(vi)  an aquatic reserve under the Fisheries Management Act 1994, or
(vii)  land identified on a map held by the by the council as being flood liable, contaminated, or subject to subsidence or slip, and
(j)  does not contravene any condition of a development consent applying to the land.

9B   Complying development
(1)  Development specified as complying development in Development Control Plan No 19—Exempt and Complying Development as adopted by the council on 28 February 2000 is complying development despite any other provision of this plan provided it satisfies all of the applicable criteria in Table 2 of the Development Control Plan and:
(a)  it is local development of a kind that can be carried out with consent on the land on which it is proposed, and
(b)  it is not an existing use as defined in section 106 of the Act, and
(c)  it achieves the outcomes in the relevant Schedule of the Development Control Plan, and
(d)  it meets the deemed-to-satisfy provisions of the Building Code of Australia, and
(e)  it is carried out at least one metre from any easement or public sewer main and complies with the building over sewer requirements of Sydney Water Corporation applying to the land, and
(f)  it is not on land that contains threatened species, populations or endangered ecological communities or land that is affected by a recovery plan or threat abatement plan under the Threatened Species Conservation Act 1995, and
(g)  a certificate of compliance has been obtained for the development, if required, from Sydney Water Corporation, and
(h)  the development is not on land identified in an environmental planning instrument as containing acid sulphate soils and requiring the adequacy of an acid sulphate management plan to be considered before consent can be granted to the development, and
(i)  the development is not on land that is:
(i)  dedicated or reserved under the National Parks and Wildlife Act 1974, or
(ii)  dedicated or reserved under the Crown Lands Act 1989 for the preservation of flora, fauna or geological formations or for other environmental protection purposes, or
(iii)  listed on the State Heritage Register or subject to an Order under the Heritage Act, or
(iv)  an Aboriginal place, under the National Parks and Wildlife Act 1974, or
(v)  identified in an environmental planning instrument as a wetland, or is within 20 metres of a wetland, or
(vi)  an aquatic reserve under the Fisheries Management Act 1994, or
(vii)  listed as an item of the environmental heritage in Schedule 6 of Hunter’s Hill Local Environmental Plan No 1 or in a draft local environmental plan, or
(viii)  land identified on a map held by the council as being flood liable, contaminated, or subject to subsidence or slip, or
(ix)  within an area which has a high bushfire risk, and
(j)  the development does not contravene any condition of a development consent applying to the land, and
(k)  the development has any necessary approval for any activity referred to in section 78A (3) of the Act; or under council’s Tree Preservation Order to remove any tree.
(2)  A complying development certificate issued for any such development must include those conditions applicable to that particular type of development the subject of the certificate that are specified in Development Control Plan No 19—Exempt and Complying Development adopted by council as in force when the certificate is issued.

Part 3 Special provisions
10   Restrictions on subdivisions
(1)  Land to which this plan applies shall not be subdivided without the consent of the council.
(2)  The council shall not consent to the subdivision of land within Zone No 2 (a2) or 2 (a3), unless:
(a)  each allotment which will be created by the subdivision has an area of:
(i)  in the case of land within Zone No 2 (a2), not less than 900 square metres, or
(ii)  in the case of land within Zone No 2 (a3), not less than 1000 square metres, and
(b)  the council is satisfied that the subdivision will not have an adverse effect on the maintenance and preservation of the landform and landscape of the land subdivided.
(3)  When calculating the area of a hatchet-shaped allotment for the purposes of this clause, the area of the access corridor shall be excluded.
(4)  Nothing in this plan restricts or prohibits the subdivision of land:
(a)  to create allotments intended to be used for any utility installation, or
(b)    (Repealed)

12   Minimum size for certain allotments
(1)  A person shall not erect a dwelling-house on an allotment of land:
(a)  within Zone No 2 (a1), 2 (b) or 2 (c), if the allotment has an area of less than 700 square metres, or
(b)  within Zone No 2 (a2), if the allotment has an area of less than 900 square metres,
(c)  within Zone No 2 (a3), if the allotment has an area of less than 1000 square metres.
(2)–(4)    (Repealed)
(5)  Nothing in this clause shall operate to prohibit the erection of a dwelling-house within Zone No 2 (a1), 2 (a2), 2 (a3), 2 (b) or 2 (c) on an allotment of land which has the same boundaries as it had on the appointed day.
(6)  A person shall not erect a hotel on any allotment of land having an area of less than 4 000 square metres.
(7)  A person shall not erect a motel, hospital or educational establishment on an allotment of land unless the allotment has:
(a)  an area of not less than 3 000 square metres, and
(b)  where the allotment has a frontage to a main road or a county road—a frontage to that road of not less than 27 metres.

13   Residential flat buildings and low-rise multi-unit housing—density and garden area controls
(1)  In this clause:
bedroom means any room which, in the opinion of the council, is designed, built or easily adaptable for use as a bedroom.
garden area means any area within an allotment of land which has not been built on and which, in the opinion of the council, is designed, constructed or adapted for outdoor living or outdoor recreation, but does not include decks, balconies or swimming pools (other than swimming pools with a water surface area of less than 40 square metres and which don’t project more than 150mm above ground level), driveways, parking areas, drying yards or other service areas.
(2)  In applying the provisions of subclause (3) and Column 2 of the Table to this clause to development for the purpose of residential flat buildings or low-rise multi-unit housing on the part of the land in Victoria Road, Gladesville, shown edged heavy black on Sheet 1 of the map marked “Hunter’s Hill Local Environmental Plan No 18” and known as “Riverglade” that is within Zone No 2 (b) or 2 (c), the site area is taken to consist not only of that part of that land but also to include so much of that land as is zoned Special Uses—Heritage Conservation or within Zone No 6 (b).
(3)  The council shall not consent to the erection of a building to be, or the use of a building as, a residential flat building or low-rise multi-unit housing, on land within a zone specified in Column 1 of the Table to this clause, unless the site area on which the building is to be erected or used is not less than the area calculated by multiplying the number of bedrooms in the building by the area specified for that zone in Column 2 of the Table.
(4)  The council shall not consent to the erection of a building to be, or the use of a building as, a residential flat building or low-rise multi-unit housing, on land within a zone specified in Column 1 of the Table to this clause, unless the proportion of the site area which is to be used as garden area is equal to or greater than the proportion specified for that zone in Column 3 of the Table.

14   Restrictions on excavations
Where, immediately before 27 June 1951, any land within Zone No 2 (a1), 2 (a2), 2 (a3), 2 (b) or 2 (c) was used for the purpose of winning any extractive material, no excavation for that purpose shall be made, opened or extended on or under that land within 15 metres of adjoining land which is within Zone No 2 (a1), 2 (a2), 2 (a3), 2 (b) or 2 (c) and was not, immediately before 27 June 1951, in the same ownership as the firstmentioned land.
15   Height of buildings
(1)  In this clause, ground level, in relation to the carrying out of development on a site, means the level of the site immediately before the development is carried out.
(2)  A person shall not erect a building on a site within Zone No 2 (a1), 2 (a2), 2 (a3), 2 (b), 2 (c), or 5 (a):
(a)  containing more than 2 storeys, or
(b)  having a height greater than 7.2 metres measured vertically from ground level to the uppermost ceiling,
or both.
(3)  A person shall not erect a building on a site within Zone No 3 (b), 3 (c):
(a)  containing more than 3 storeys, or
(b)  having a height greater than 8 metres measured vertically from any point on ground level to the uppermost ceiling,
or both.
(4)  A person shall not erect a building on a site within Zone No 3 (a):
(a)  containing more than 3 storeys, or
(b)  having a height greater than 9 metres measured vertically from any point on ground level to the uppermost ceiling,
or both.

15A   Height of development on certain land in Victoria Road, Gladesville
(1)  This clause applies to land shown hatched on Sheet 1 of the map marked “Hunter’s Hill Local Environmental Plan No 18” and known as “Riverglade”.
(2)  Notwithstanding the provisions of clause 15, a person may, with the consent of the council, erect a building containing not more than 3 habitable floors on land to which this clause applies.

15B   Building height for certain land at 2 Salter Street, Huntleys Cove
(1)  This clause applies to Lot 1, DP 1128422, being part of 2 Salter Street, Huntleys Cove (and being land adjoining “The Priory”), as shown edged heavy black and lettered “2 (c)” on the map marked “Hunter’s Hill Local Environmental Plan No 53”.
(2)  Despite clause 15, a person may, with the consent of the council, erect one or more buildings containing not more than 3 habitable floors above a basement car park on the land to which this clause applies, but only if any such building does not have a height greater than 12 metres measured vertically from any point on ground level to the uppermost roof ridge.

16A   Garden area
(1)  In this clause, garden area means any area within an allotment of land which has not been built on and which, in the opinion of the council, is designed, constructed or adapted for outdoor living or outdoor recreation but does not include decks, balconies or swimming pools (other than swimming pools with a water surface area of less than 40 square metres and which don’t project more than 150 mm above ground level), driveways, parking areas, drying yards or other service areas.
(2)  The council shall not grant consent to the erection or use of a building on an allotment of land within Zone No 2 (a1), 2 (a2) or 2 (a3) unless the allotment has a garden area equal to or greater than 50% of the area of the allotment.
(3)  Notwithstanding subclause (2), the council shall not grant consent to the erection or use of a building on an allotment of land within a zone referred to in that subclause which has a frontage to the Lane Cove River or the Parramatta River unless the allotment has a garden area equal to or greater than 60% of the area of the allotment.

17A   Integrated housing development
(1)  The council shall not grant consent to integrated housing development unless:
(a)  the area of the allotment on which a building is to be added to, altered or erected so as to contain 2 dwellings is not less than 700 square metres, excluding the area of the access corridor of a hatchet shaped allotment, and
(b)  the area of the allotment on which a second detached dwelling-house or 2 new detached dwelling-houses are to be erected is not less than 900 square metres, excluding the area of the access corridor of a hatchet shaped allotment, and
(c)  the allotment (or each of the allotments) has a garden area (within the meaning of clause 16A) equal to or greater than 50% of the area of the allotment (or 60% in the case of an allotment having a frontage to the Lane Cove River or the Parramatta River), and
(d)  where there is an existing dwelling-house on the allotment concerned, any second detached dwelling-house that will be erected does not exceed 3.6 metres in height, and
(e)  where the development is to be carried out on a vacant allotment (whether or not after an existing dwelling-house is demolished) and two detached dwelling-houses are to be erected on that allotment, the dwelling-house furthest from the street does not exceed 3.6 metres in height.
(2)  In any integrated housing development, off-street parking space shall be provided for each dwelling in accordance with the following standards:
(a)  in the case of the division of a single dwelling-house into two dwellings—1 car parking space for each dwelling,
(b)  in the case of the addition of a second dwelling-house having a gross floor area of less than 125m2—1 car parking space for each dwelling,
(c)  in the case of the addition of a second dwelling-house having a gross floor area exceeding 125m2—1 car parking space for the existing dwelling-house and 2 car parking spaces for the additional dwelling-house,
(d)  in the case of the erection of two new dwelling-houses—1 car parking space for each dwelling having a gross floor area of less than 125m2 or 2 car parking spaces for each dwelling having a gross floor area exceeding 125m2.
(3)  The council shall not grant consent for a second dwelling unless it is satisfied that:
(a)  adequate provision is made in respect of the privacy of the proposed dwelling and any adjacent dwelling-house, including the curtilage thereof, and
(b)  adequate provision is made in respect of access to natural light for the proposed dwelling and any adjacent dwelling-house, including the curtilage thereof.
(4)  The council shall not grant consent to integrated housing development unless it is satisfied that arrangements satisfactory to it have been made for provision of a water supply to each dwelling and for the disposal of sewage and stormwater from each dwelling.

18   Foreshore building lines
(1)  The council may, by resolution, fix a line (in this clause called a foreshore building line) in respect of any land fronting any bay, creek, harbour or river.
(2)  A foreshore building line shall, when fixed in accordance with subclause (1), be marked upon a plan or clearly described in the resolution and the plan or resolution on which it is marked or by which it is described shall be available at the office of the council for inspection by the public during the office hours of the council.
(3)  The council may, by resolution, alter or abolish any foreshore building line, other than the one referred to in subclause (6), where the levels, depth or other exceptional features of a site affected by the line make it, in the opinion of the council, necessary or expedient to do so.
(4)  A building shall not be erected or rebuilt between a foreshore building line and the bay, creek, harbour or river in respect of which the line is fixed.
(5)  Notwithstanding subclause (4), the council may consent to:
(a)  the erection of:
(i)  retaining walls and steps,
(ii)  swimming pools which will not project above natural ground level,
(iii)  fences not exceeding 1.5 metres in height, or
(iv)  boatsheds, or
(v)    (Repealed)
(b)  the rebuilding of dwelling-houses which existed immediately before the appointed day,
where the erection or rebuilding, as the case may be, will result in a contravention of subclause (4).
(6)  The council shall not grant consent under the Act pursuant to this clause unless it has made an assessment of the effect that the structure, work or dwelling-house, would have, if it were erected or rebuilt, upon the appearance of the adjacent foreshore and the environmental heritage of the Municipality of Hunter’s Hill.
(7)  A broken black line shown on the map and identified as a foreshore building line by reference to a linear measurement and the letters “F.S.B.L.” shall be deemed to be a foreshore building line fixed in accordance with subclause (1).

18A   Foreshore Scenic Protection Area
The council may not grant consent under the Act to an application to carry out development on land within the Foreshore Scenic Protection Area, being that area shown by hatching on the map marked “Hunter’s Hill Local Environmental Plan No 14—Heritage Conservation” unless it has made an assessment of:
(a)  the appearance and visual quality of the proposed development when viewed from the waterway, and
(b)  the impact of the proposed development on the view towards the waterway from public roads and from public reserves or from land within Zone No 6 (a) or 6 (b).

19   Items of the environmental heritage
(1)  A person shall not, in respect of a building, work, relic, tree or place that is an item of the environmental heritage:
(a)  demolish or alter the building or work,
(b)  damage or move the relic,
(c)  excavate for the purpose of exposing the relic,
(d)  damage or despoil the place or tree, or
(e)  erect a building on or subdivide land on which the building, work or relic is situated or that comprises that place,
except with the consent of the council.
(2)  The council shall not grant consent under the Act pursuant to subclause (1) in respect of an item of the environmental heritage, unless it has made an assessment of:
(a)  the significance of the item as an item of the environmental heritage of the Municipality of Hunter’s Hill,
(b)  the extent to which the carrying out of development in accordance with the consent would affect the heritage significance of the item and its site,
(c)  whether the setting of the item and, in particular, whether any stylistic, horticultural or archaeological features of the setting, should be retained, and
(d)  the extent to which the carrying out of development in accordance with the consent would affect the form of an historic subdivision described in Schedule 6.
(3)  The council shall not grant consent to an application to carry out development on land in the vicinity of an item of the environmental heritage unless it has made an assessment of the effect which the carrying out of that development will have on the heritage significance of the item and its setting.
(4)  The council shall not grant consent under the Act pursuant to subclause (1) to the alteration of a building that is an item of the environmental heritage, unless it has made an assessment of:
(a)  the colour, texture, style, size and type of finish of any materials to be used on the exterior of the building and the effect which the use of those materials will have on the appearance of the exterior of the building and of any other building in its vicinity,
(b)  the style, size, proportion and position of openings for any windows and doors which will result from or be affected by, the carrying out of the development, and
(c)  the pitch and form of the roof, if any.
(5)  A person shall not, in respect of a contributory building listed in Schedule 7:
(a)  demolish or alter the contributory building, or
(b)  carry out any development on land on which any such contributory building is situated,
except with the consent of the council.
(6)  The council shall not grant consent under the Act pursuant to subclause (5) in respect of a contributory building listed in Schedule 7, unless it has made an assessment of:
(a)  the extent to which the original exterior features and form of the contributory building are intact,
(b)  the extent to which the original exterior features and form of any adjoining contributory buildings listed in Schedule 7 are intact,
(c)  the contribution of the contributory building (having regard to its position) to the character of the street,
(d)  the contribution of the contributory building to the history of the area, and
(e)  whether the contributory building constitutes a danger to users or occupiers, if any, of the contributory building.

19A   Conservation areas
(1)  A person shall not, in respect of a conservation area:
(a)  demolish or alter a building or work within the area,
(b)  damage or move a relic within the area,
(c)  excavate for the purpose of exposing a relic within the area,
(d)  damage or despoil a place within the area, or
(e)  erect a building on or subdivide land within the area,
except with the consent of council.
(2)  The council shall not grant consent to an application to carry out development on land within a conservation area unless it has made an assessment of the extent to which the carrying out of the development in accordance with the consent would affect the heritage significance of the conservation area.
(3)  The council shall not grant consent to an application, being an application to erect a new building or to alter the exterior of an existing building, unless the council has made an assessment of:
(a)  the pitch and form of the roof,
(b)  the style, size, proportion and position of the openings for windows and doors, and
(c)  whether the colour, texture, style, size and type of finish of the materials to be used on the exterior of the building are compatible with the materials used in the existing buildings in the conservation area.

19B   Conservation Advisory Panel
The council, in making an assessment of the matters referred to in clauses 19 (2), (3), (4) and (6) and 19A (2) and (3), may consult with the Conservation Advisory Panel, being a committee appointed by the council to advise on items of the environmental heritage and on conservation areas.

19C   Heritage advertisements
(1)  Except as provided by this clause, the provisions of sections 84, 85, 86, 87 (1) and 90 of the Act apply to and in respect of:
(a)  the demolition of an item of environmental heritage, and
(b)  the demolition of a building, work, relic or place within a conservation area,
in the same way as those provisions apply to and in respect of designated development.
(2), (3)    (Repealed)
(4)  This clause does not apply to the partial demolition of an item of the environmental heritage or a building or work within a conservation area if, in the opinion of the council, the partial demolition will be of a minor nature and will not adversely affect the heritage significance of the item of the environmental heritage in relation to the environmental heritage of the Municipality of Hunter’s Hill.

19D   Conservation incentives relating to items of the environmental heritage
(1)  Nothing in this plan prevents the council from granting consent to:
(a)  the use for any purpose of a building that is an item of the environmental heritage or the land on which the item is erected, or
(b)  the use for any purpose of a building within a conservation area or of the land on which the building is erected,
where the council is satisfied that:
(c)  the use would have little or no adverse effect on the amenity of the area, and
(d)  conservation of the building depends on the council granting consent in pursuance of this clause.
(2)  When considering an application to erect a building on land on which there is situated a building which is an item of the environmental heritage, the council may:
(a)  for the purposes of determining the floor space ratio and the garden area of the land, and
(b)  for the purposes of determining the number of parking spaces to be provided on the land,
exclude from its calculation of the floor space of the buildings erected on the land the floor space of the item, but only if the council is satisfied that the conservation of the building depends upon the council granting that exclusion.

20   Proposed new alignment of road
The council shall not consent to development, other than development which will, in the opinion of the council, result in the carrying out of minor repairs and improvements, on land between the existing alignment of a road and the proposed new alignment, as shown on the map by a broken black line and the words “proposed new alignment”.

22   Suspension of certain covenants, agreements etc
(1)  For the purpose of enabling development to be carried out in accordance with this plan (as in force at the time the development is carried out) or in accordance with a consent granted under the Act, the operation of any covenant, agreement or instrument imposing restrictions on development, to the extent necessary to serve that purpose, shall not apply to the development.
(2)  Nothing in subclause (1) shall affect the rights or interests of the council under any registered instrument.
(3)  Pursuant to section 28 of the Act, before the making of this clause, the Governor approved subclauses (1) and (2).

23   Payment towards provision or improvement of amenities or services
As a consequence of the carrying out of development in accordance with this plan (as in force when the development is carried out), this plan identifies a likely increased demand for public amenities and public services as specified in Schedule 5 and stipulates that dedication or a contribution under section 94 (1) of the Act, or both, may be required as a condition of any consent to that development.
24   Acquisition of reserved lands
Note—
Nothing in this clause is to be construed as requiring a public authority to acquire land—see section 27 (3) of the Act.
(1)  The owner of any land within:
(a)  Zone No 9 (a),
(b)  Zone No 9 (b), or
(c)  Zone No 9 (c),
may by notice in writing, require:
(d)  the council,
(e)  the Commissioner for Main Roads, or
(f)  the corporation constituted under section 8 (1) of the Act,
respectively, to acquire that land.
(2)  On receipt of a notice referred to in subclause (1), the public authority concerned shall acquire the land to which the notice relates.
(3)  Land to which this clause applies may be developed for any purpose with the consent of the council until that land is acquired by the council or a public authority.
(4)  The Council must not grant consent, referred to in subclause (3), to the development of land to be acquired by a public authority other than the RTA, unless it has taken the following into consideration:
(a)  the effect of the proposed development on the costs of acquisition,
(b)  the imminence of acquisition,
(c)  the costs associated with the reinstatement of the land for the purposes, if any, specified under the heading “Development which requires consent” in the matter relating to the relevant land in the Table to clause 9.

25   Advertisement of certain applications
(1)  Pursuant to section 30 (4) of the Act, the provisions of sections 84, 85, 86, 87 (1) and 90 of the Act apply to and in respect of development on land within Zone No 2 (a1), 2 (a2), 2 (a3), 2 (b) or 2 (c) for the purpose of a car park, a child care centre, a community centre, an educational establishment, a home industry, a hospital, a place of public worship or a residential flat building in the same way as those provisions apply to and in respect of designated development.
(2)  Nothing in subclause (1) requires the documents accompanying a development application to be made available for inspection at any office other than the office of the council.
26   Amendment of the County of Cumberland Planning Scheme Ordinance
The County of Cumberland Planning Scheme Ordinance is amended by inserting in clause 4 after the word “land” the words “(other than the land to which Hunter’s Hill Local Environmental Plan No 1 applies)”.
27   Development on certain land at Gladesville
(1)  This clause applies to land shown edged heavy black on the map marked “Hunter’s Hill Local Environmental Plan No 6”.
(2)  Notwithstanding clause 15, a person may, with the consent of the council, erect a building on land to which this plan applies:
(a)  containing habitable rooms on not more than 3 floors,
(b)  to a height of not more than 13 metres measured vertically from the level of the highest point of the building (not being a vent, chimney, lift tower or other service installation) to the ground level of the site at the lowest point of the building, and
(c)  if the ratio of the gross floor area of the building to the site area of the land on which the building is to be erected does not exceed 1:1.

27A   Development of land within 2.5 metres of a zone boundary—“Riverglade”, Victoria Road, Gladesville
(1)  This clause applies to land shown edged heavy black on Sheet 1 of the map marked “Hunter’s Hill Local Environmental Plan No 18” and known as “Riverglade” within a zone shown on that map which is within 2.5 metres of the boundary of land within an adjoining zone.
(2)  A person may, but only with the consent of the council, carry out development on land to which this clause applies for any purpose for which the land within an adjoining zone may lawfully be developed.

28   Development within Zone Nos 2 (a2), 2 (b) and 6 (a)—Pulpit Point

(2)  A person shall not, on land to which this clause applies, carry out development for any purpose without the consent of the Council.
(3)  In deciding whether to grant consent pursuant to subclause (2), the consent authority shall take into consideration the following matters:
(a)  the height and population density of the proposed development,
(b)  the type of construction of the proposed development,
(c)  the materials proposed to be used in the construction of the proposed development,
(d)  the effect of Naval Safety Regulations on the proposed development.

29   Development prohibited on unrehabilitated land at Pulpit Point

(b)  the Secretary of the Department of Health,

31   Development of land within 20 metres of zone boundary—Pulpit Point
(1)  Except as provided by subclause (2), this clause applies to land shown by distinctive colouring or edging on the map marked “Hunters Hill Local Environmental Plan No 11” within a zone shown on that map which is within 20 metres of the boundary of land within an adjoining zone.
(2)  This clause does not apply to land shown on the map referred to in subclause (1) within a zone which is within 20 metres of the boundary of land within Zone No 2 (a2), 2 (b) or 9 (d) shown hatched on that map.
(3)  A person may, with the consent of the Council, carry out development on land to which this clause applies for any purpose for which the land may lawfully be developed within an adjoining zone.

(1)  This clause applies to land within Zone No 5 (a) if the particular purpose indicated for the land by scarlet lettering on the map is a school, college or other educational institution.
(2)  Despite any other provision of this plan, a person may, with the consent of the council:
(a)  develop the facilities and site of a school, college or other educational institution on land to which this clause applies for the purpose of any community use, and
(b)  carry out any such development whether or not the development is ancillary to use of the land for the purpose of a school, college or other educational institution.

(1)  This clause applies to land known as 10 Ryde Road, Hunter’s Hill, being Lots 19 and 20, Sec 3, DP 235–CT.
(2)  Notwithstanding clause 13 (4), the council may grant consent to the erection of, or the use of a building as, low-rise multi-unit housing on land to which this clause applies if the site area per bedroom is at least 70 square metres and the proportion of the site area to be used as garden area is at least 40%.
(3)  Notwithstanding clause 15 (2) (a), the council may grant consent to the erection of a building on land to which this clause applies that has 3 floors if:
(a)  the building fronts onto Ryde Road, and
(b)  the top most floor of the building is situated within the roof in the form of an attic room, and
(c)  the roof pitch of the building does not exceed 36 degrees.
(4)  Notwithstanding clause 15 (2) (b), the council may grant consent to the erection of a building on land to which this clause applies that has a height of not more than 10 metres if:
