Bank of New South Wales (Change of Name) Act 1982 No 31



An Act to change the name of the body politic and corporate constituted by the Bank of New South Wales Act of 1850; and for other purposes.
1   Name of Act
This Act may be cited as the Bank of New South Wales (Change of Name) Act 1982.
2   Commencement
(1)  This section and section 1 shall commence on the date of assent to this Act.
(2)  Except as provided in subsection (1), this Act shall commence on such day as may be appointed by the Governor in respect thereof and as may be notified by proclamation published in the Gazette.
3   Definition
In this Act, appointed day means the day appointed and notified pursuant to section 2 (2).
4   Change of name
On and from the appointed day, the corporate name of the body politic and corporate constituted by the Bank of New South Wales Act of 1850 shall be “Westpac Banking Corporation”.
5   Savings
The change of name of the body referred to in section 4 effected by the operation of that section does not operate:
(a)  to create a new legal entity,
(b)  to prejudice or affect the identity of that body or its continuity as a body politic and corporate,
(c)  to affect the property, or the rights and obligations, of the body, or
(d)  to render defective any legal proceedings by or against that body,
and any legal proceedings that could have been continued or commenced by or against that body in its former corporate name may be continued or commenced by or against it in its new corporate name.
6   References to former name
On and from the appointed day, a reference in any Act, other than this Act, or in any statutory instrument or other instrument, whether of the same or of a different nature, being an instrument which came into existence before the appointed day, to “The Bank of New South Wales” or “Bank of New South Wales” shall be read and construed as a reference to “Westpac Banking Corporation”.
