An Act to repeal the Coomealla Irrigation Area Deep Drainage Act 1939; and for other purposes.
1 Name of Act
This Act may be cited as the Coomealla Irrigation Area Deep Drainage (Repeal) Act 1979.
2 Commencement
(1) This section and section 1 shall commence on the date of assent to this Act.(2) Except as provided in subsection (1), this Act shall commence on the day appointed and notified under section 2 (2) of the Water (Amendment) Act 1979.
3 Repeal of Act No 3, 1939
The Coomealla Irrigation Area Deep Drainage Act 1939 is repealed.

5 Works deemed to have been constructed under the Irrigation Act 1912
Any drainage works constructed, before the day referred to in section 2 (2), under the Coomealla Irrigation Area Deep Drainage Act 1939, in the Coomealla Irrigation Area, shall be deemed to have been constructed under the Irrigation Act 1912, as amended by the Irrigation (Amendment) Act 1979, as if the Irrigation Act 1912, as so amended, had been in force at the time they were constructed.
6 Provisions of Irrigation Act 1912 deemed to apply
The provisions of the Irrigation Act 1912, as amended by the Irrigation (Amendment) Act 1979, shall be deemed to apply to and in respect of the drainage works constructed under the Coomealla Irrigation Area Deep Drainage Act 1939, in the same way as they apply to and in respect of drainage works constructed under the Irrigation Act 1912, as so amended.
7 Waiver of rates and contributions by Water Resources Commission
In respect of drainage works constructed, before the day referred to in section 2 (2), under the Coomealla Irrigation Area Deep Drainage Act 1939, in the Coomealla Irrigation Area, the Water Resources Commission constituted under section 4 of the Water Resources Commission Act 1976, may, by notification published in the Gazette, waive any rate, or the balance of any contribution, payable under Part 2 of the Irrigation (Amendment) Act 1941, and outstanding immediately before that day, and the waiver has effect as if that rate or balance had been paid.
