Real Property (Legal Proceedings) Act 1970 No 92



An Act relating to certain legal proceedings instituted against the Registrar-General; and for purposes connected therewith.
1   Name of Act
This Act may be cited as the Real Property (Legal Proceedings) Act 1970.
2   In certain circumstances, certain provisions of Act No 25, 1900, not to apply
(1)  In this section prescribed proceedings means proceedings instituted in the Supreme Court of New South Wales:
(a)  by Denton Subdivisions Pty. Limited (in liquidation), No 9218 of 1965, against Jack Hayward Watson the Registrar General of New South Wales, and
(b)  by Hermes Trading & Investment Pty. Limited, No 4114 of 1967, against Registrar General.
(2)  If a plaintiff in prescribed proceedings:
(a)  had, before the first day of July, one thousand nine hundred and seventy, a cause of action on which to found those proceedings, and
(b)  would, but for this Act, have been deprived of that cause of action by the coming into force of subsection five of section 33A of the Real Property Act 1900,
that subsection shall, for the purpose of the prescribed proceedings, be deemed not to have come into force.
