University of Sydney (Law School Site) Act 1967 No 26



An Act to vest part of a public road in The University of Sydney; and for purposes connected therewith.
1   Name of Act and commencement
(1)  This Act may be cited as the University of Sydney (Law School Site) Act 1967.
(2)  This Act shall commence upon a day to be appointed by the Governor and notified by proclamation published in the Gazette.
2   Application of Act No 55, 1946
(1)  Subject to this section, the land described in the Schedule to this Act shall be deemed to have been appropriated or resumed (together with all mines and deposits of coal, ironstone, kerosene, shale, limestone, slate or other minerals thereunder) immediately before the commencement of this Act under subsection five of section four of the Land Acquisition (Charitable Institutions) Act 1946, and the provisions of that Act applicable to land that has been so appropriated or resumed (subsection seven of section four excepted) shall apply, mutatis mutandis, to and in respect of that land.
(2)  For the purposes of that application, a notification referred to in section forty-two of the Public Works Act 1912, as amended by subsequent Acts, describing or referring to the land described in the Schedule to this Act shall be deemed to have been published in the Gazette immediately before the commencement of this Act.
3   Vesting of land in the University of Sydney
(1)  The land described in the Schedule to this Act shall, on and from the commencement of this Act, vest in The University of Sydney for the same estate and subject to the same reservations, exceptions, provisions, restrictions and conditions as are set forth in Crown grant dated the twelfth day of April one thousand nine hundred and sixty-five and registered Volume 9972 Folio 191.
(2)  For the purposes of the Conveyancing and Law of Property Act 1898, the land is to be taken to have been the subject of a Crown grant on the same conditions as are set forth in the Crown grant referred to in subsection (1).

4   Issue of certificate of title
Upon application by The University of Sydney and upon payment of the prescribed fee, the Registrar-General shall issue to The University of Sydney a certificate of title under the Real Property Act 1900, as amended by subsequent Acts, for the land described in the Schedule to this Act, without requiring any survey of the land and without investigation of the title of The University of Sydney thereto except so far as may be necessary to give effect to this Act.

ALL THAT PIECE or parcel of land situated at Sydney in the City of Sydney Parish of St. James County of Cumberland and State of New South Wales being formerly part of Lots 3 and 4 in Deposited Plan No 10775 and containing an area of 72 square feet COMMENCING at a point being the intersection of the eastern side of Elizabeth Street as widened and the northern side of King Street and bounded thence on the west by part of that side of Elizabeth Street aforesaid bearing 355 degrees 49 minutes 35 seconds 12 feet 0 inches; thence on the north-east by a line bearing 131 degrees 29 minutes 10 seconds 17 feet 2 inches to the northern side of King Street aforesaid; thence on the south by part of that side of King Street bearing 267 degrees 08 minutes 45 seconds 12 feet 0 inches to the point of commencement be the said area and several mentioned dimensions all a little more or less AND LIMITED IN HEIGHT to the strata between reduced level 48.00 and reduced level 84.11 and to the strata between reduced level 114.00 and reduced level 300.00 all the aforesaid levels being determined from Standard Datum.
