An Act to provide for the setting apart of certain Crown land at Moree for the establishment and maintenance thereon of a Moree and District War Memorial Educational Centre; to appoint trustees thereof; and for purposes connected therewith.
1 Name of Act and commencement
(1) This Act may be cited as the Moree and District War Memorial Educational Centre Act 1962.(2) This Act shall commence upon a day to be appointed by the Governor and notified by proclamation published in the Gazette.
2 Definitions
In this Act, unless the context or subject matter otherwise indicates or requires:Educational Centre means Moree and District War Memorial Educational Centre.Regulations means regulations made under this Act.
3 Dedication
(1) The land described in the Schedule to this Act (hereinafter referred to as the said land) is hereby set apart and dedicated for the purposes of the establishment and maintenance thereon and the use of the Educational Centre.(2) Any trusts, conditions or dedications affecting the said land immediately before the commencement of this Act are hereby revoked and annulled.
4 Educational Centre and application of Committee’s funds
(1) The Educational Centre shall comprise and make provision for:(a) an assembly hall and ancillary facilities,(b) a library and ancillary facilities,(c) an activities room, and(d) such other amenities in connection with educational or cultural activities as the Minister may from time to time approve.(2) All moneys in the hands of the Moree and District War Memorial Educational Centre Committee and raised by such Committee or its predecessors in connection with the proposal to establish a war memorial at Moree may be applied by such Committee towards the establishment of the Educational Centre.
5 Use of Educational Centre
(1) Subject to the regulations:(a) the assembly hall and its facilities within the Educational Centre shall be available for occupation by the pupils of the public schools at Moree under the supervision of a teacher, at all reasonable times, free of charge, and(b) the library and its facilities within the Educational Centre shall be controlled and managed by the Moree Regional Public Library Committee as a library and for the purposes of library services upon such terms and conditions as may be agreed upon between the Moree Regional Public Library Committee and the trustees.(2) The Educational Centre may be used for education and cultural purposes and such other purposes as may be approved by the trustees upon such terms and conditions as may be determined by the trustees.Such terms and conditions may include terms and conditions as to the payment to the trustees of such charges as the trustees may think proper.
6 Trustees
(1) The Minister may by notification published in the Gazette appoint three trustees of the Educational Centre and the said land. Of such trustees:(a) one shall be an officer of the Department of Education who shall be chairman,(b) one shall be the chairman of the Moree Regional Public Library Committee,(c) one shall be an alderman of the Moree Plains Shire Council.(2) The trustees in the exercise of their powers, authorities, duties and functions shall be subject to the control and direction of the Minister.(3) The trustees and their successors shall be a body corporate under the name of the “Trustees of the Moree and District War Memorial Educational Centre”, shall have perpetual succession and a common seal and may sue and be sued by that name in all courts.s 6: Am 1984 No 153, Sch 16.
7 Management committee
(1) There shall be a management committee of the Educational Centre and the said land. The management committee shall comprise the headmaster for the time being of Moree High School and the executive member for the time being of the Moree Regional Public Library Committee.(2) Such management committee, for and on behalf of the trustees, shall, subject to this Act and the regulations and the control and direction of the trustees, have the care, control and management of the Educational Centre and the said land.
8 Accounts and annual report
The trustees shall cause proper books of account to be kept in relation to the funds dealt with by them as trustees, and shall, as soon as practicable, and not more than three months after the thirtieth day of June in each year prepare and transmit to the Minister, statements of accounts in a form approved by the Auditor-General exhibiting a true and correct view of the financial position and transactions of the trustees, and also a report of their work and activities during the year ending on that date.
9 Surplus funds
Any surplus funds arising from the use of the Educational Centre shall be paid to the Department of Education to be applied towards the cost of the improvement, repair and maintenance of the Educational Centre.
10 Regulations
(1) The Governor may make regulations not inconsistent with this Act for and with respect to:(a) the care, control and management of the Educational Centre and the said land,(b) the regulation of the use and enjoyment of the Educational Centre and the said land,(c) the regulation of meetings of the trustees and the proceedings thereat,(d) the filling of casual vacancies in the office of trustee,(e) the conferring upon the trustees of powers, authorities, duties and functions additional to those prescribed by this Act,(f) the common seal of the body corporate, and(g) all matters which by this Act are required or permitted to be prescribed or which are necessary or convenient to be prescribed for carrying out or giving effect to this Act.(2) (Repealed)s 10: Am 2009 No 106, Sch 3.23.

All that piece or parcel of land containing by admeasurement 1 rood 15½ perches, be the same more or less situated in the parish of Moree county of Courallie at Moree being portion 488 Commencing at the intersection of the south-eastern side of Albert Street with the north-eastern side of Balo Street and bounded thence on the north-west by part of the south-eastern side of Albert Street aforesaid bearing 81 degrees 31 minutes 30 seconds 127.27 links on the north-east by the most northerly south-western boundary of portion 225 bearing 171 degrees 30 minutes 272.73 links on the south-east by the most westerly north-western boundary of portion 225 aforesaid bearing 261 degrees 31 minutes 30 seconds 127.27 links and on the south-west by part of the north-eastern side of Balo Street aforesaid bearing 351 degrees 30 minutes 272.73 links to the point of commencement, as shown on plan catalogued C2951 1880R in the Department of Lands.
