St. Anne’s Church of England (Ryde) Cemetery Act 1940 No 9



An Act to provide for the removal of human remains and certain slabs and tombstones from a portion of the cemetery attached to St. Anne’s Church of England, at Ryde, for the reinterment of such remains and the re-erection of such slabs and tombstones in the Field of Mars Church of England Cemetery at Ryde; and for purposes connected therewith.
1   Name of Act
This Act may be cited as the St. Anne’s Church of England (Ryde) Cemetery Act 1940.
2   Removal of remains
(1)  The Commissioner for Main Roads appointed under the Transport (Division of Functions) Act 1932 may cause the remains of all persons buried in the lands described in the Schedule to this Act (so far as such remains can by reasonable diligence be discovered or identified), together with all slabs or tombstones in relation thereto, to be collected with due care and removed from the lands described in the Schedule to this Act to the Field of Mars Church of England Cemetery at Ryde, and shall cause such remains to be reverently reinterred and such slabs or tombstones to be re-erected.
(2)  The cost of removing and reinterring such remains and of removing and re-erecting such slabs and tombstones shall be paid from the County of Cumberland Main Roads Fund under the Main Roads Act 1924–1939.
3   No compensation payable
No compensation shall be payable to any person in respect of the performance of any act authorised by this Act.
Schedule
THAT portion of the cemetery attached to St. Anne’s Church of England, Ryde, and proposed to be acquired by the Commissioner for Main Roads in connection with the widening and reconstruction of Victoria road within the Municipality of Ryde, and more particularly described as follows:
All that piece or parcel of land situate in the Municipality of Ryde, parish of Hunter’s Hill, county of Cumberland and State of New South Wales, being part of the land in Certificate of Title register volume 4723 folio 225: commencing at the intersection of a north-western side of Little Church street with a north-eastern side of Victoria road; and bounded thence on the south-west by part of that side of that road bearing 305 degrees 10 minutes 173 feet 7 inches to the south-eastern side of Church street; thence on the north-west by part of that side of that street bearing 20 degrees 47 minutes 30 seconds 45 feet 0⅜ inch; thence on the north-east and again on the north-west by marked lines bearing consecutively 162 degrees 58 minutes 45 seconds 18 feet 11½ inches, 125 degrees 10 minutes 155 feet 8 inches and 78 degrees 16 minutes 16 feet 4¾ inches to the north-western side of Little Church street aforesaid; thence on the south-east by part of that side of that street bearing 211 degrees 22 minutes 44 feet 0⅞ inch, to the point of commencement.
