Major Events Regulation 2010



Her Excellency the Governor, with the advice of the Executive Council and on the recommendation of the Premier under section 5 of the Major Events Act 2009, has made the following Regulation under the Major Events Act 2009.

Part 1 Preliminary
1   Name of Regulation
This Regulation is the Major Events Regulation 2010.
2   Commencement
This Regulation commences on the day on which it is published on the NSW legislation website.
3   Definition
(1)  In this Regulation:
the Act means the Major Events Act 2009.
(2)  Notes included in this Regulation do not form part of this Regulation.
Part 2 Sydney International FIFA Fan Fest
4   Declaration of SIFFF as a major event
(1)  The Sydney International FIFA Fan Fest (SIFFF) is declared to be a major event.
(2)  For the purposes of section 5 (4) (a) of the Act, the SIFFF is a free event:
(a)  that is to be held at Darling Harbour during the 2010 FIFA World Cup from 11 June 2010 until 12 July 2010, and
(b)  that will enable the Sydney community and visitors to share the 2010 FIFA World Cup experience, and
(c)  that will provide live broadcasts on one or more giant screens of the 2010 FIFA World Cup final matches and associated screen based and stage based entertainment, and
(d)  that may include features such as a barge in Cockle Bay for a main screen and stage, temporary event marquees, stalls and signage structures, security fencing, seating, food and drink stalls, toilets and associated festival facilities.
(3)  For the purposes of section 5 (4) (b) of the Act, the declaration of the SIFFF as a major event is in force from 1 June 2010 until 20 July 2010 (the major event period).
Note—
The major event period includes lead-in and lead-out time to enable construction and removal of facilities.
(4)  For the purposes of section 5 (4) (c) of the Act, the following provisions of Part 4 of the Act apply in relation to the SIFFF for the whole of the major event period:
(a)  Division 6 (Environmental Planning and Assessment Act 1979),
(b)  Division 8 (Protection of the Environment Operations Act 1997),
(c)  section 61 (No liability in nuisance).
(5)  For the purposes of section 51 of the Act, 20 July 2010 is prescribed as the expiry date.
5   Director-General of Department of Planning is responsible authority for SIFFF
The Director-General of the Department of Planning is designated as the responsible authority for the Sydney International FIFA Fan Fest.
