Trades Hall (Transfer of Land) Act 1970 No 54



An Act to authorise the transfer of certain land from trustees appointed by the Governor to a body corporate; to remove certain restrictions on the use of the land; to provide for the repeal of the Trades Hall and Literary Institute Act of 1893; and for purposes connected therewith.
1   Name of Act
This Act may be cited as the Trades Hall (Transfer of Land) Act 1970.
2   Registrar-General may register certain memorandum of transfer
(1)  The persons specified in a certificate furnished by the Minister for the purposes of this section shall be deemed to have full power and authority to transfer to The Trades and Industrial Hall and Literary Institute Association of Sydney Limited the land described in the Schedule to this Act.
(2)  Where a memorandum of transfer of the land described in the Schedule to this Act to The Trades and Industrial Hall and Literary Institute Association of Sydney Limited is lodged with the Registrar-General for registration, the Registrar-General shall not be concerned to enquire whether, or be affected by notice of the fact that:
(a)  the memorandum of transfer is required to be executed by any person in lieu of the persons specified in a certificate furnished by the Minister pursuant to subsection one of this section,
(b)  the memorandum of transfer is a dealing the registration of which is prohibited by caveat number 377701, caveat number 535255 or caveat number B379304,
(c)  any case has arisen for forfeiture, reverter or reentry in respect of the land comprised in certificate of title volume 2619 folio 69, or
(d)  the memorandum of transfer is a dealing in breach of any trust, condition, proviso or reservation (not being a reservation of minerals) created or imposed by grant from the Crown volume 761 folio 123,
and may register the memorandum of transfer notwithstanding any such notice.
3   Dissolution of certain trusts etc
The registration of a memorandum of transfer under section two of this Act shall operate:
(a)  to dissolve the trusts protected by caveat number 377701, caveat number 535255 and caveat number B379304 to the extent necessary to authorise the Registrar-General to withdraw those caveats, and
(b)  to dissolve, revoke and annul any trusts, conditions, provisos, reservations (other than reservations of minerals), rights of reverter, restrictions on alienation and provisions for the appointment of trustees arising under, contained in or imposed by grant from the Crown volume 761 folio 123.
4   Restriction on transfer of certain land
A transfer by The Trades and Industrial Hall and Literary Institute Association of Sydney Limited of the land comprised in certificate of title volume 2619 folio 69 shall be void and of no effect unless the Minister consents thereto.
5   Recordings by Registrar-General
The Registrar-General may, on the registration of a memorandum of transfer under section two of this Act, make such recordings in the register kept by him under the Real Property Act 1900 as to him seem necessary or convenient in consequence of the enactment of this Act and in consequence of that registration, and may make any recording with respect to the effect of paragraph (b) of section three, or of section four, of this Act by reference to this Act.
6   Stamp duty
No stamp duty under the Stamp Duties Act 1920 shall be chargeable upon a memorandum of transfer referred to in section two of this Act.
7   Repeal of certain Acts
(1)  The Trades Hall and Literary Institute Act of 1893 and the Trades Hall and Literary Institute (Amendment) Act 1916 are hereby repealed.
(2)  Subsection one of this section shall commence upon a day to be appointed by the Governor and notified by proclamation published in the Gazette, being a day that is not earlier than the day on which a memorandum of transfer under section two of this Act is registered.

All those pieces or parcels of land situate in the city of Sydney parish of St. Andrew and county of Cumberland being the whole of the land comprised in certificates of title volume 1436 folio 232, volume 1986 folio 103, volume 2619 folio 69 and volume 3906 folio 123.
