Notification requirements and arranging for notification
The process for notifying an instrument differs depending on how the instrument was made and whether it was drafted by PCO.
Please note that instruments are ordinarily notified on a Friday and published on the Notification page of the legislation website.

Instruments made at ExCo and drafted by PCO
Automatic notification
If an instrument is made at an Executive Council (ExCo) meeting and drafted by PCO, we will automatically notify it on the first Friday after the meeting. You do not need to submit a request for notification.
ExCo meetings are generally held on a Wednesday and the instruments made at the meeting are notified 2 days later on the Friday.
Early notification
If your instrument has to be notified before the first Friday after the ExCo meeting (for example, the instrument commences on the same day as the meeting), you’ll need to submit a request for early notification.
The request should be sent to notification@pco.nsw.gov.au before 1pm on the day the instrument is to be notified. You’ll also need to provide written confirmation that the instrument was approved at the ExCo meeting.
Delayed notification
If you do not want your instrument to be notified on the first Friday after the ExCo meeting, please make sure you—
- record the intent to delay notification in the explanatory note that accompanies the instrument when it is considered at the ExCo meeting, and
- send a request to delay notification to notification@pco.nsw.gov.au before 5pm on the day of the ExCo meeting.
Generally, we will not agree to delay notification by more than 4 weeks from the Friday after the ExCo meeting.
When you’re ready for a delayed instrument to be notified, please email notification@pco.nsw.gov.au no later than 1pm on the intended notification date and include the following information—
- the name of the instrument,
- the proposed notification date,
- PCO’s file reference, which you can find on the bottom left-hand side of the instrument (e/s202X-XXX.dXX).
Instruments made at ExCo but not drafted by PCO
To notify an instrument that was made at an Executive Council (ExCo) meeting but not drafted by PCO, please email notification@pco.nsw.gov.au by 5pm on Wednesday for the instrument to be notified on Friday. You’ll need to provide the following—
- the name of the instrument,
- the proposed notification date,
- a scanned copy of the signed instrument,
- a PDF of the instrument in an A4 format. The PDF should not be a scan. Please type in the signatory’s name and the date of signing.
If your instrument needs to be notified on a day other than Friday, please submit the request for notification at least 2 days before the intended notification date.
Instruments not made at ExCo
Local environmental plans and map amendments
Requests to notify local environmental plans (LEPs) and map amendments should be sent to HGENotifications@planning.nsw.gov.au, which is managed by the Department of Planning, Housing and Infrastructure.

Other instruments
To notify an instrument that was not made at an Executive Council (ExCo) meeting, please email notification@pco.nsw.gov.au by 5pm on Wednesday for the instrument to be notified on Friday. You’ll need to provide the following—
- the name of the instrument,
- the proposed notification date,
- a scanned copy of the signed instrument,
- if the instrument was drafted by PCO—
- PCO’s file reference, which you can find on the bottom left-hand side of the instrument (e/s202X-XXX.dXX),
- the signatory’s name and title,
- if the instrument was not drafted by PCO—
- a PDF of the instrument in an A4 format. The PDF should not be a scan. Please type in the signatory’s name and the date of signing.
If your instrument needs to be notified on a day other than Friday, please submit the request for notification at least 2 days before the intended notification date.
