9.13 Authorised officer may give remediation notice
(1) An authorised officer may, by notice given to a person (a remediation notice), require the person to carry out specified remediation work on Crown land within a period specified in the notice.(2) Before doing so, the authorised officer must be satisfied that the Crown land (or any habitat, plant or animal in or on the land) has been damaged in, or as a result of, the commission of an offence against this Act or the regulations by the person.(3) A remediation notice may be given regardless of whether proceedings for the offence have been brought or the person has been convicted of the offence.(4) A remediation notice may be varied or revoked in a further written notice given to the person.(5) In this section:damaged includes contaminated.
