1 Name of regulation
This regulation is the Disability Inclusion Regulation 2023.
2 Commencement
This regulation commences on 1 September 2023.Note—This regulation replaces the Disability Inclusion Regulation 2014, which is repealed on 1 September 2023 by the Subordinate Legislation Act 1989, section 10(2).
3 Definition
In this regulation—the Act means the Disability Inclusion Act 2014.Note—The Act and the Interpretation Act 1987 contain definitions and other provisions that affect the interpretation and application of this regulation.
4 Definition of “public authority”—the Act, s 7
For the Act, section 7(1), definition of, paragraph (c), the following entities are prescribed—(a) Australian Museum Trust,(b) Destination NSW,(c) Library Council of New South Wales.
5 Day from which certain public authorities must prepare and make disability inclusion action plans—the Act, s 12
For the Act, section 12(1), the prescribed day is the day that is 6 months after—(a) for a government department or a local council established after the commencement of this regulation—the day on which the department or council is established, or(b) for an entity prescribed as a public authority under the Act, section 7(1), definition of , paragraph (c) after the commencement of this regulation—the day on which the entity is prescribed.
6 Appointment of chairperson and deputy chairperson of Disability Council—the Act, s 16
(1) For the Act, section 16(5)(b), the Minister must, by written instrument, appoint a member of the Disability Council as the chairperson of the Council.(2) For the Act, section 16(6), the Minister must, by written instrument, appoint a member of the Disability Council as the deputy chairperson of the Council.
7 Saving
An act, matter or thing that, immediately before the repeal of the Disability Inclusion Regulation 2014, had effect under that regulation continues to have effect under this regulation.
