1 Name of Regulation
This Regulation is the Air Transport Regulation 2016.
2 Commencement
This Regulation commences on 1 September 2016 and is required to be published on the NSW legislation website.Note—This Regulation replaces the Air Transport Regulation 2006 which is repealed on 1 September 2016 by section 10 (2) of the Subordinate Legislation Act 1989.
3 Definitions
(1) In this Regulation:quarter means the period of 3 months ending on 30 September, 31 December, 31 March or 30 June.Sydney-linked route means any route that begins or ends at, or passes through, Sydney (Kingsford-Smith) Airport.the Act means the Air Transport Act 1964.Note—The Act and the Interpretation Act 1987 contain definitions and other provisions that affect the interpretation and application of this Regulation.(2) Notes included in this Regulation do not form part of this Regulation.
4 Statistical information to be provided
(1) A person involved in the operation or provision of air transport services within New South Wales must, within 6 weeks after the end of each quarter, provide information to the Secretary as to the total number of passengers carried by the person during that quarter over each Sydney-linked route over which the person operates or provides those services.(2) Compliance with the requirements of this clause may be made a condition of a licence granted under section 6 of the Act.
