5.10 Sale of certain leased Crown land permitted
(1) The Minister can sell Crown land even if there is a lease over the land under this Act except if it is a perpetual lease or a purchasable lease.(2) The sale of the Crown land does not operate to terminate the lease.(3) Instead, the lease continues in force on the sale’s completion as a lease between the purchaser and the lessee.(4) The provisions of the lease also continue in force, but only to the extent that they would be enforceable at law if contained in a lease between persons not forming part of, or representing, the Crown or the State.
